An Act to confer certain Powers upon the Wellington Harbour Board.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Wellington Harbour Board Empowering Act, 1910.
2 Special Act.
This Act shall be deemed a special Act within the meaning of the Harbours Act, 1908.
3 Interpretation.
In this Act, if not inconsistent with the context, “the Board”
means the Wellington Harbour Board.
4 Authority to Board to postpone construction of dock.
(1.)
Notwithstanding anything to the contrary in any Act contained, the Board is hereby authorized to postpone the construction of a graving-dock, including any preliminary works necessary therefor, until it deems it expedient to construct the same.
Existing rights, &c., protected.
(2.)
Nothing in this section shall affect any right, claim, or demand existing on the commencement of this Act and vested in a contractor or subcontractor for the construction of or the supply of any materials for any such dock, and such right, claim, or demand shall notwithstanding the passing of this Act remain in the same force and effect as if this Act had not been passed.
5 Vesting land in Board.
The land described in the Fourth, Thirteenth, and Fourteenth Schedules of the Wellington Harbour Board and Corporation Empowering Act, 1898, shall remain vested in the Board, but discharged from the use of it for a graving-dock, floating dock, or slip, or any other special purpose for which it was liable to be used immediately prior to the passing of this Act, so that such land may be held henceforth by the Board for all or any of the purposes for which the Board is constituted.
6 Authority to employ moneys.
Any sum of money standing to the credit of the Dock Fund Account created by the Wellington Harbour Board Empowering Act 1902 Amendment Act, 1903, may be used for any of the works, acts, matters, and things authorized to be undertaken by the Board.
7 Authority to construct dock.
The Board may at any time construct a dock, and may apply the sum of two hundred and fifty thousand pounds (part of the loan authorized by the Wellington Harbour Board Reclamation and Empowering Act, 1908) to the construction of such dock and works incidental thereto.
