An Act to empower the Corporation of the Borough of Mosgiel to sell a certain Parcel of Land in the said Borough with the Buildings thereon, and to pay the Proceeds of such Sale into the District Fund of the said Borough.

Preamble.

WHEREAS the parcel of land described in the Schedule hereto was purchased by the Corporation of the Mayor, Councillors, and Burgesses of the Borough of Mosgiel, with moneys belonging to the District Fund of the said borough, for the purpose of providing and maintaining public offices within the said borough for holding the meetings and transacting the business of the Council of the said borough, and for the use of its officers, and for holding public meetings and transacting public business relating to the said borough: And whereas the said parcel of land is unsuitable for the said purpose, and it is expedient that power should be given to the said Corporation to sell and dispose of the said parcel of land:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

This Act may be cited as the Mosgiel Borough Empowering Act, 1911.

2 Interpretation.

In this Act “the Corporation” means the Mayor, Councillors, and Burgesses of the Borough of Mosgiel.

3 Power to sell and convey land.

Notwithstanding anything in the Municipal Corporations Act, 1908, or in any other statute, the Corporation shall have power to sell the parcel of land described in the Schedule hereto and the buildings thereon for such price, and upon such terms and conditions, as to the Corporation shall seem meet, and to convey the said parcel of land to the purchaser or purchasers thereof.

4 Purchase-money to be paid into District Fund

All purchase-money received by the Corporation in respect of such sale of the said parcel of land shall be paid into and form part of the District Fund of the Borough of Mosgiel.

Schedule

All that parcel of land, containing by admeasurement 16 poles, more or less, situate in the East Taieri District, in the Provincial District of Otago being part of original section numbered 12, Block II, on the map of the said district: commencing at a point on the main road from Saddle Hill to West Taieri distant in a south-easterly direction 154 ft. 2 in from the north-westerly corner of the said Section 12, Block II, East Taieri District, and extending thence in a line in a north-easterly direction, 100 ft.; thence in a south-easterly direction, 44 ft.; thence in a south-westerly direction, 100 ft., to the main road from Saddle Hill to West Taieri aforesaid; and thence along the said road in a north-westerly direction, 44 ft., to the starting-point: as the same parcel of land is described in the deed of conveyance, registered No. 77323, in the Deeds Registry Office, at Dunedin, and is delineated in the plan drawn thereon.
