An Act to amend the Christchurch District Drainage Act, 1907, and to validate the Expenditure of certain Moneys, and the Making, Levying, and Collecting of certain Rates, by the Christchurch Drainage Board.
Preamble.
WHEREAS by the Christchurch District Drainage Act, 1875, and divers Acts amending the same, and finally by the Christchurch District Drainage Act, 1907 (hereinafter called the said consolidating Act), being an Act to consolidate the said Acts, the Christchurch Drainage Board was empowered (inter alia) to cleanse, repair, or otherwise maintain in a due state of efficiency any watercourse or outfall for water or any bank or defence against water within the district constituted by the said Christchurch District Drainage Act, 1875, and the Acts amending the same; and the said Board was further empowered to make and levy a rate upon the rateable property within the said district once in every year for the purposes of such Acts: And whereas the district constituted by the said Christchurch District Drainage Act, 1875, included within its area the River Heathcote during a portion of its course and which river is within the meaning of the word “watercourse”
as defined by the said Act and the said consolidating Act: And whereas the said Board, in pursuance and exercise of the powers vested in it, has from time to time expended moneys’ in cleansing, repairing, or otherwise maintaining the said Heathcote River, and has made, levied, and collected rates in respect of the moneys so expended; and, in particular, has so expended moneys, and has made, levied, and collected rates in respect thereof since the passing of the said consolidating Act: And whereas by the said consolidating Act the district theretofore constituted by the several Acts thereby consolidated was purported to be described by the description of the said district set forth in the First Schedule thereto, the same being a new description: And whereas it has been found that certain portions of the course of the said River Heathcote which had been included within the former description of the said district were by inadvertence omitted therefrom: And whereas it is desirable to amend the description of the said district and of its bounds so as to expressly include such portions of the said river therein, and to remove all doubts as to the true boundaries thereof; and also to validate the expenditure of the moneys so as aforesaid expended by the said Board in respect of the cleansing, repairing, or otherwise maintaining of the said river, and the making, levying, and collecting of rates in respect thereof, since the passing of the said consolidating Act:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Christchurch District Drainage Amendment Act, 1914, and shall form part of and be read together with the said consolidating Act.
2 Repeal.
So much of the First Schedule to the said consolidating Act as has not already been repealed by sections nine and ten of the Christchurch District Drainage Act, 1908, and the said sections nine and ten are hereby repealed.
3 Subdistricts within the meaning of the consolidating Act.
The several subdistricts described in the Schedule hereto shall be the subdistricts within the meaning of subsection one of section three of the said consolidating Act.
4 Boundary-lines defined.
Wherever in the said Schedule hereto any road, street, or avenue is mentioned as bounding any part of any area therein described, then in every such case, unless the contrary is stated or implied, the medium filum of such road, street, or avenue shall be deemed to be the boundary-line.
5 Expenditure, &c., in respeot of the Heathcote River validated.
All money expended by the said Board in respect of the cleansing, repairing, or otherwise maintaining of the said River Heathcote since the passing of the said consolidating Act shall be deemed to have been lawfully and regularly expended under the powers vested in it; and all rates made, levied, and collected by the said Board in respect of such expenditure, or purporting to be made, levied, or collected in respect thereof, shall be deemed to have been validly made, levied, and collected by the said Board.
6 Section 7 of consolidating Act amended.
Section seven of the consolidating Act is hereby amended by substituting the word “last”
for the word “second.”
7 Section 8 of consolidating Act amended.
Subsection one of section eight of the consolidating Act is hereby amended by omitting the words “second Tuesday in January in every succeeding third year,”
and substituting the words “last Tuesday in January in every succeeding third year.”
8 Section 10 of consolidating Act amended.
Section ten of the consolidating Act is hereby amended by substituting the word “elector”
for the word “ratepayer.”
9 Section 10 of consolidating Act amended.
Section nineteen of the consolidating Act is hereby amended by substituting the word “February”
for the word “January.”
Schedule
North-east Christchurch Subdistrict.
Bounded by a line commencing at the intersection of Colombo Street and Bealey Avenue; thence along Bealey Avenue to North Avon Road; thence northerly, easterly, and again northerly and easterly along that road and a line running due east to the left bank of the River Avon; thence along the left bank of that river to a point in line with the middle of Fitzgerald Avenue; thence across the river and along Fitzgerald Avenue to Worcester Street; and thence along Worcester Street and Colombo Street respectively to the place of commencement.
North-west Christchurch Subdistrict.
Bounded by a line commencing at a point on the right bank of the River Avon in line with the middle of West Belt; thence along the right bank of that river to a point in line with the middle of Bealey Avenue; thence across the said river and along Bealey Avenue to Colombo Street, along that street to Worcester Street, along Worcester Street and a line in continuation thereof to West Belt; and thence along West Belt, forming the eastern boundaries of Rural Sections Nos. 10 and 163, to the place of commencement.
South-east Christchurch Subdistrict.
Bounded by a line commencing at the intersection of Colombo Street and Worcester Street; thence along Worcester Street to Fitzgerald Avenue, along that avenue to Moorhouse Avenue, along Moorhouse Avenue to Colombo Street, and along that street to the place of commencement.
South-west Christchurch Subdistrict.
Bounded by a line commencing at a point in the middle of West Belt, west of Hagley Park, in line with the middle of Worcester Street; thence to and along Worcester Street to Colombo Street, along Colombo Street to Moorhouse Avenue; thence along that avenue and its continuation to West Belt; and thence along West Belt to the place of commencement.
Sydenham Subdistrict.
Bounded by a line commencing at the junction of Wilson’s Road and Ferry Road; thence along Ferry Road to Fitzgerald Avenue, along that avenue to Moorhouse Avenue; thence along Moorhouse Avenue to Lincoln Road, along Lincoln Road to Bright’s Road; thence along Bright’s Road, Jerrold Street, South Crescent Road, and Strickland Street to Colombo Street, and along Colombo Street to the right bank of the River Heathcote; thence along the right bank of that river to Wilson’s Road Bridge, across the said river, and along Wilson’s Road to Ferry Road, the place of commencement.
St. Albans Subdistrict.
Bounded by a line commencing at the northernmost corner of Rural Section No. 242; thence along Norman’s Road to Papanui Road, along Papanui Road to May’s Road, along May’s Road to Rutland Street, along Rutland Street to McFadden’s Road, along McFadden’s Road to Philpott’s Road, along Philpott’s Road to Innes Road, along Innes Road to Rural Section No. 345a; thence along the south-western boundaries of Rural Sections Nos. 345a and 2795 to Shirley Road, along Shirley Road to Hill’s Road, along Hill’s Road and North Avon Road to Bealey Avenue; thence along Bealey Avenue to and across the River Avon; thence along the right bank of that river to a point opposite the middle of Rossall Street, across the river, and along Rossall Street and along the road forming part of the south-eastern boundary of Rural Section No. 133 to and across the Wairarapa Stream; thence along the right bank of that stream and along the north-eastern boundary of Rural Section No. 242 to its northernmost corner, the place of commencement.
Linwood Subdistrict.
Bounded by a line commencing at a point on the left bank of the River Avon in line with the middle of Linwood Avenue; thence across that river and along Linwood Avenue to Aldwin’s Road, along Aldwin’s Road to Ferry Road, along Ferry Road to Ensor’s Road, along Ensor’s Road to the southern side of the Christchurch-Lyttelton Railway Reserve, along the southern side of that reserve to Wilson’s Road, along Wilson’s Road and Ferry Road to Fitzgerald Avenue; thence along that avenue to and across the River Avon; and thence along the left bank of that river to the place of commencement.
Avon Subdistrict.
Bounded by a line commencing at the crossing of the Purarekanui Stream (Styx River) by the North Road; thence due east to the sea; thence along the seashore to the estuary of the Heathcote and Avon Rivers; thence along the eastern shore of that estuary and the left bank of the River Avon to the north-eastern corner of the North-east Christchurch Subdistrict hereinbefore described, along the northern boundary of that subdistrict and the eastern and northern boundaries of St. Albans Subdistrict to the south-eastern corner of Rural Section No. 453; thence along the north-eastern boundaries of Rural Sections Nos. 453 and 2382, across a road, and Rural Sections Nos. 1101 and 2200 and the south-eastern boundary of Rural Section No. 323 to the road forming the south-western boundary of Rural Section No. 203, and along that road to North Road; and thence along North Road to the Purarekanui Stream, the place of commencement.
Heathcote Subdistrict.
Bounded by a line along the left bank of the River Avon from a point in line with the middle of Linwood Avenue to the New Brighton Tramway Bridge; thence across the said river and along its right bank and the western side of the estuary of the Heathcote and Avon Rivers to the Canal and Road Reserve; thence along that reserve, along Linwood Avenue, and across the Avon River to the place of commencement: also all that area bounded by a line commencing at the crossing of Wilson’s Road by the Christchurch-Lyttelton Railway; thence along the southern side of that railway to and across the Heathcote River, along the right bank of that river to Wilson’s Road Bridge, across the said river, and along Wilson’s Road to the railway-line, the place of commencement.
Woolston Subdistrict.
Bounded by a line commencing at the easternmost corner of the Linwood Subdistrict hereinbefore described; thence along the south-western boundary of the Heathcote Subdistrict and the western side of the estuary of the Heathcote and Avon Rivers to Ferry Road Tramway Bridge; thence across the Heathcote River and along its right bank to the Christchurch-Lyttelton Railway, along the southern side of that railway to Ensor’s Road, and along the south-eastern boundary of Linwood Subdistrict to the place of commencement.
Riccarton Subdistrict.
Bounded by a line commencing at the crossing of the Purarekanui Stream (Styx River) by North Road; thence along the western boundaries of the Avon, St. Albans, North-west Christchurch, and South-west Christchurch Subdistricts hereinbefore described to Lincoln Road; thence along Lincoln Road to Lincoln and Riccarton Junction Road, and along the south-western side of that road, the southern side of Riccarton Road, and the western side of Waimairi Road to the Waimairi Stream, along the right hank of that stream and the south-western side of Coringa Road to Woolridge’s Road, along the western side of that road, the northern side of Harewood Road to Gardner’s Road; thence along the north-western side of Gardner’s Road, the western side of the road forming the western boundaries of Rural Sections Nos. 1165, 734, 566, and 533a, and the northern side of Styx Road to the western boundary of Rural Section No. 243, along the western boundary of that section to the northern side of the Purarekanui Stream, and along the northern side of that stream to North Road, the place of commencement.
Spreydon Subdistrict.
Bounded by a line commencing at the westernmost corner of Sydenham Subdistrict hereinbefore described; thence along the south-western boundary of that subdistrict to the Heathcote River, along the right bank of that river to Lincoln Road; and thence along Lincoln Road to the place of commencement.
