An Act to vest certain Lands in the Waiapu County Council.
Preamble.
WHEREAS by Proclamation dated the ninth day of April, nineteen hundred and eight, the Waiapu County Council was empowered to exercise all the powers of a Harbour Board in respect of the port or harbour of Tokomaru Bay within the limits defined in such Proclamation: And whereas it is expedient in order to enable the proper exercise of the said powers to vest in the said Council the lands hereinafter described, and to empower the said Council to do the acts and things hereinafter mentioned:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Tokomaru Bay Harbour Act, 1915.
2 Authority to reclaim certain lands.
(1.)
The Governor in Council, in the name and on behalf of His Majesty, may issue a grant to the Waiapu County Council of the lands described in the Schedule hereto for harbour purposes, and the Council, after the issue of such grant, shall have authority to reclaim the same or any part thereof from the sea.
(2.)
All rents, issues, and profits arising or derived from the said lands shall be paid into and form part of the Harbour Fund Account.
Schedule Description of Foreshore
All that area in the Hawke’s Bay Land District lying between high-water and low-water marks and extending southwards from Kotunui Point along the shore of Tokomaru Bay to Te Mawhai Point.
