An Act to vest certain of the Foreshores and Mud-flats within the Harbour of Whangarei in the Whangarei Harbour Board.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

(1.)

This Act may be cited as the Whangarei Harbour Board Vesting Act, 1917.

(2.)

This Act shall be deemed to be a special Act within the meaning of the Harbours Act, 1908, and the amendments thereof, which are accordingly incorporated herewith, and shall be read and construed along with the Whangarei Harbour Act, 1907.

2 Vesting of foreshore and mud-flats in Board.

On the passing of this Act the lands described in the Schedule hereto, excepting any Native land as defined by the Native Land Act, 1909, and any Native fishing-grounds and fisheries, shall vest in and be the property of the Whangarei Harbour Board (hereinafter called the Board) as endowment lands.

3 Resumption without compensation.

Notwithstanding that the said lands shall be vested in the Board, it shall be lawful for the Governor-General, in pursuance of the Public Works Act, 1908, or its amendments, to take and proclaim any part or parts thereof not actually occupied for the purposes of railways or roads without paying compensation therefor.

SCHEDULES

Schedule

All those portions of land in the Whangarei Harbour in Block XIII of the Whangarei Survey District, and Block XVI, Purua Survey District, lying between high and low water at ordinary spring tides, extending on the western shore-line of the said harbour southwards from boundary of said block to Onemana Point, and on the western shore-line southwards from railway-bridge, Block XIII, to the Graham Town (Onerahi) Railway-wharf, but exclusive of the land required for railway purposes, as shown on plans deposited in the office of the Minister of Public Works and marked P.W.D. 38531 and P.W.D. 8720 and P.W.D. 19932; the land to be vested being hereinafter more particularly described, namely:—

All that area comprising 146 acres, more or less, as shown marked B on plan deposited in the office of the Marine Department, at Wellington, as M.D. 4835, and thereon shaded light blue.

2.

All that area comprising 390 acres, more or less, as shown marked C on plan deposited in the office of the Marine Department, at Wellington, as M.D. 4835, and thereon shaded light blue.

3.

All that area comprising 25 acres, more or less, as shown marked D on plan deposited in the office of the Marine Department, at Wellington, as M.D. 4835, and thereon shaded light blue.

4.

All that area comprising 90 acres, more or less, as shown marked E on plan deposited in the office of the Marine Department, at Wellington, as M.D. 4835, and thereon shaded light blue.

5.

All that area comprising 367 acres, more or less, as shown marked F on plan deposited in the office of the Marine Department, at Wellington, as M.D. 4835, and thereon shaded light blue.

6.

All that area comprising 104 acres, more or less, as shown marked G on plan deposited in the office of the Marine Department, at Wellington, as M.D. 4835, and thereon shaded light blue.
