An Act to authorize the Manawatu County Council to raise a Loan for Tramway and other Purposes, and to confer other Powers on the said Council.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Manawatu County Loan and Empowering Act, 1917.
2 Interpretation.
In this Act, if not inconsistent with the context,—
“Council” means the Manawatu County Council:
“Tramway” means the tramway from Himatangi to Pukenui under the control of the Manawatu County Council.
3 Power to raise loan for certain purposes.
The Council may, without further authority than this Act, and notwithstanding anything contained in any other Act, but with the precedent consent of the Governor-General in Council, given pursuant to section twenty-six of the Appropriation Act, 1915, raise a special loan of not exceeding eighteen thousand pounds for and in connection with all or any of the following purposes, that is to say:—
(a.)
The extension of the line of the tramway into the bed of the Rangitikei River:
(b.)
The laying of new sidings to the line of the tramway, and the relaying of any part or parts of the existing line of the tramway:
(c.)
The erection and acquisition of buildings, structures, machinery, and plant for the purposes of the tramway, and the making of alterations and additions in and to existing buildings, structures, machinery, and plant:
(d.)
The acquisition of any land or estate or interest in land for the purposes of the tramway or of any buildings or works connected therewith:
(e.)
The acquisition of additional locomotives, wagons, and carriages for the purposes of the tramway:
(f.)
The repayment to the Council’s General Account of the sum of eleven hundred and seventy-seven pounds heretofore expended out of such account for the purposes of the tramway:
(g.)
The acquisition, erection, and equipment of a stone-crushing and elevating plant:
(h.)
The acquisition of road-making plant and machinery, and the refunding to the General Account of any sums expended for such purposes since the first day of April, nineteen hundred and seventeen.
(2.)
The said loan may be raised over the whole of the County of Manawatu or over any portion thereof to be defined by the Council.
(3.)
The said loan shall not be raised without the consent of the ratepayers of the county or of such defined portion thereof, such consent to be given at a poll taken under the provisions of the Local Bodies’ Loans Act, 1913.
(4.)
Except as regards the said sum of eleven hundred and seventy-seven pounds, it shall not be necessary for the Council to appropriate any portion of the said loan-moneys to any of the foregoing purposes in the proposal to be submitted to the ratepayers.
4 Local Bodies’ Loans Act, 1913, to apply.
Subject to the provisions of this Act, the said loan shall be raised as a special loan under the Local Bodies’ Loans Act, 1913, and the Council may pledge and make a special rate over all rateable property in the County of Manawatu, or in such defined part thereof as aforesaid, as security for the said loan, and all the provisions of the last-mentioned Act shall, subject as aforesaid, apply to the said loan; provided, however, that section fifteen of the said Act shall not apply to the case of said loan.
5 Saving of other powers.
Nothing in this Act shall be deemed to limit any powers possessed by the Council independently of this Act.
