An Act to provide for the Sale of the Auckland Museum Site and for the Acquisition of another Site for such Museum.
Preamble.
WHEREAS the society known as the Auckland Institute and Museum, incorporated as a branch society with the New Zealand Institute under the provisions of the New Zealand Institute Act, 1867, has established and maintained a public Museum and Institute in the City of Auckland upon the lands firstly and secondly described in the First Schedule hereto: And whereas the title to the land so firstly described is held under a Crown grant to the Superintendent of the Province of Auckland and his successors as a site for an Auckland Institute, which Crown grant bears date the twentieth day of October, eighteen hundred and sixty-nine, and is registered in the Deeds Register Office at Auckland as Number 40792: And whereas the trustees for the said society are incorporated under the Religious, Charitable, and Educational Trust Boards Incorporation Act, 1884, under the name of “The Auckland Institute and Museum Trust Board”
: And whereas it is considered that the present site of the Museum and Institute is unsuitable, and that the efficiency and development of such Museum and Institute would be materially promoted if the same could be removed to a larger and more suitable site: And whereas the Auckland City Council have agreed to allow the said Board to erect the Museum and Institute upon the land particularly described in the Second Schedule hereto, being a portion of the Auckland Domain vested in it by the Auckland Domain Vesting Act, 1893, provided the necessary legislative authority is obtained enabling it in this behalf: And whereas the said society is desirous of selling the lands described in the First Schedule hereto, and of erecting a public Museum and Institute upon the land described in the Second Schedule hereto:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Auckland Institute and Museum Site Empowering Act, 1918.
2 Interpretation.
In this Act, if not inconsistent with the context,—
“Board” means the Auckland Institute and Museum Trust Board:
“Corporation” means the Mayor, Councillors, and Citizens of the City of Auckland.
3 Certificate of title to be issued to Board.
The District Land Registrar for the District of Auckland shall upon the surrender to him of the said Crown grant registered as Number 40792 issue a certificate of title to the Board for an estate in fee-simple in the said piece of land firstly described in the First Schedule hereto, and thereupon the said Crown grant so issued to the said Superintendent of the Province of Auckland for such land shall be and be deemed to be cancelled.
4 Power to sell land, &c.
The Board shall have power, at the request and by the direction of the Council of the said Auckland Institute and Museum, to sell the said lands firstly and secondly described in the First Schedule hereto, and the buildings thereon, for such price and upon such terms and conditions as to the Board shall seem meet, and to transfer the same to the purchaser or purchasers thereof for an estate in fee-simple free of all restrictions and encumbrances.
5 Purchase-moneys to be applied to erection of Museum, &c.
All purchase-moneys received by the Board in respect of such sale shall be applied either in or towards the erection of a Museum and Institute building on the site described in the Second Schedule hereto or for the general purposes of the Museum and Institute as the Council thereof may deem expedient or advisable.
6 Power for Corporation to lease land to Board, &c.
Notwithstanding the provisions of the Auckland Domain Vesting Act, 1893, or any other Act, it shall be lawful for the Corporation either—
(a.)
To lease to the Board the land particularly described in the Second Schedule hereto as a site for a public Museum and Institute for such period, and at a rent not to exceed one pound per annum, and upon such terms and conditions, and with such means of access through the Auckland Domain or otherwise, as the Council of the Corporation may deem expedient; or
(b.)
To set apart from the said Auckland Domain the land particularly described in the Second Schedule hereto to be used exclusively as a site for a public Museum and Institute, and to permit and allow the Board to erect and maintain thereon a public Museum and Institute for such period, and upon such terms and conditions, and with access as aforesaid, as the Council of the Corporation may deem advisable in the public interests;
Provided always that if and so long as any such tenancy or occupancy as aforesaid shall continue the Mayor of the City of Auckland (ex officio) and also two members of the Auckland City Council annually appointed by such Council shall be members of the Council of the said Institute and Museum.
SCHEDULES
FIRST SCHEDULE
Firstly, all that piece of land in the Provincial District of Auckland, in the Dominion of New Zealand, containing by admeasurement 1 rood 6·4 perches, more or less, situated in the Parish of Waitemata and County of Eden, and being Allotment 1 of Section 7 of the City of Auckland: bounded on the north by Eden Crescent, 200 links; on the east by Allotment 16, 145 links; on the south by Allotment 2 of Section 7 aforesaid, 200 links; and on the west by Princes Street, 145 links.
Secondly, all that piece of land situated in the said provincial district in the said Parish of Waitemata and County of Eden, containing 1 rood 6·4 perches, more or less, being Allotment 2 of Section 7 of the City of Auckland, and being the whole of the land comprised in certificate of title, Volume 22, folio 114, of the Register-book in the Land Transfer Office at Auckland.
As the same are delineated on a plan in the Survey Office at Auckland, numbered 20152.
SECOND SCHEDULE
All that piece or parcel of land, being portion of the Auckland Domain, containing by admeasurement 2 acres 3 roods 19·14 perches, be the same a little more or less: bounded by portions of the said domain, commencing at a point bearing 339° 40′ and distant 285·7 links from the Domain Pillar in such domain; towards the west by a line bearing 360°, 757·57 links; towards the north by a line bearing 90°, 378·78 links; towards the east by a line bearing 180°, 757·57 links; and towards the south by a line bearing 270°, 378 78 links, to the commencing-point: as the same is delineated and coloured pink on the plan No. 20152a in the Survey Office at Auckland.
