An Act to authorize the Invercargill Borough Council to expend certain Loan-moneys raised by Special Loans for Sanitary Drainage and Sewerage Works in certain Portions of the Borough for completing the Sanitary Drainage and Sewerage of the Whole Borough.
Preamble.
WHEREAS the Invercargill Borough Council has pursuant to the powers vested in it raised various special loans for providing and completing the sanitary drainage and sewerage works in certain portions of the Borough of Invercargill; the amounts of the said loans and the portions of the borough in which the said works were to be completed being as set out in the Schedule hereto: And whereas by the Invercargill Borough Council Special Rate Empowering Act, 1918, the Council of the Borough of Invercargill was authorized to levy one special rate on all the rateable property in the whole of the Borough of Invercargill to provide for the payment of the sinking funds and interest and other charges in respect of the said loans, together with certain other loans: And whereas pursuant to the said Act one special rate on all the rateable property in the whole of the said borough has been levied to provide for the payment of the said sinking funds, interest, and other charges: And whereas it is expedient that the Invercargill Borough Council should be authorized to expend any part or parts of the loan-moneys borrowed or to be borrowed in respect of the loans mentioned in the Schedule hereto in completing sanitary drainage and sewerage works in any other portion or portions of the borough:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Invercargill Borough Council Special Rate Empowering Amendment Act, 1921, and shall be read together with and deemed part of the Invercargill Borough Council Special Rate Empowering Act, 1918.
2 Authority to spend loan-moneys in other areas.
Notwithstanding anything to the contrary in the Local Bodies’ Loans Act, 1913, or any other Act, it shall be lawful for the Council of the Borough of Invercargill to expend from time to time the whole or any part or parts of the moneys borrowed or to be borrowed in respect of the loans mentioned in the Schedule hereto, or any of them, in providing, extending, and completing sanitary drainage and sewerage works in any portion or portions of the borough other than that in respect of which the loan or loans were authorized, and in completing and extending the sewerage system throughout the whole Borough of Invercargill.
3 Authority to spend loan-moneys in refunds to District Fund.
It shall be lawful for the Council of the Borough of Invercargill to expend from time to time the whole or any part or parts of the moneys borrowed or to be borrowed in respect of any of the loans mentioned in the Schedule hereto, or any of them, in repaying to the District Fund of the Borough of Invercargill any moneys paid out of the said fund for the purpose of providing, extending, or completing sanitary drainage and sewerage works in any portion or portions of the borough mentioned in the said Schedule, and notwithstanding that the moneys so repaid may have been borrowed for works for the benefit of any portion or portions of the borough other than the portion or portions for the benefit of which the said sanitary drainage and sewerage works have been carried out.
4 Advances for cost of drainage connections.
The Invercargill Borough Council is hereby authorized to appropriate out of the loans aforesaid, or out of the sewerage loan of fifty thousand pounds authorized by a poll of the ratepayers of the Borough of Invercargill taken on the first day of December, nineteen hundred and twenty, any sum not exceeding three thousand pounds as a fund out of which advances may be made for the purposes authorized by section two hundred and twenty-eight of the Municipal Corporations Act, 1920.
5 Rights of debenture-holders not affected
Nothing in this Act shall affect the rights of the holders of debentures issued in respect of any of the loans in the Schedule hereto.
