An Act to amend the Christchurch Tramway District Act, 1920.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Christchurch Tramway District Amendment Act, 1921, and shall be read together with and deemed part of the Christchurch Tramway District Act, 1920 (hereinafter referred to as the principal Act).
2 Section 3 of principal Act amended.
Section three of the principal Act is hereby amended by omitting therefrom the words “consisting of two Commissioners,”
and substituting the words “consisting of three Commissioners”
; and by omitting therefrom the words “The Commissioners in making such division shall have regard to such factors as population, rateable value of property, and the boundaries of the several districts of the various local authorities comprised within the said district.”
3 Effect of alteration of boundaries.
In any case where—
(a.)
The boundaries of all or any of the subdistricts are altered; or
(b)
The number of members for any subdistrict is altered,—
then no alteration shall be made in the representation of the district until the next ensuing triennial election, and the members for each subdistrict at the time the report of the Commissioners is gazetted shall remain in office until the next ensuing triennial election.
4 Section 4 of principal Act amended.
Section four of the principal Act is hereby amended by inserting, after the words “further Electoral Commission,”
the words “consisting of three Commissioners”
; and by omitting from paragraph (c) thereof the words “in such manner as to keep the representation of the various subdistricts as nearly as may be proportioned to the number of electors of and the value of rateable property in each subdistrict.”
5 Section 5 of principal Act amended.
Section five of the principal Act is hereby amended by inserting, after the words “the New Zealand Gazette”
the words “within twenty-eight days after the said report shall be communicated to the Board.”
6 Section 9 of principal Act amended.
Section nine of the principal Act is hereby amended by omitting from subsection one thereof the words “immediately preceding that.”
7 Section 13 of principal Act amended.
Section thirteen of the principal Act is hereby amended by omitting from subsection four thereof the words “immediately preceding that.”
8 Section 18 of principal Act amended.
Section eighteen of the principal Act is hereby amended by omitting therefrom the word “Tuesday,”
and substituting the word “Thursday.”
9 Section 34 of principal Act amended.
Section thirty-four of the principal Act is hereby amended by adding thereto the following subsection:—
“(5.)
It shall be lawful for the Board from time to time, by special order, and without taking the steps described in sections eight to twelve of the Local Bodies’ Loans Act, 1913, to raise such loans as may be necessary to cover capital expenditure of the Board consequent upon the necessary development and improvement of the Board’s existing system:
“Provided always that in no case shall any such loan be applied in the construction of any new line (but this shall not apply to the conversion of a single line into a double line), or in the extension of any existing line otherwise than for the purpose of extending the terminal fare section, if under one mile in length, to a length not exceeding one mile:
“Provided further that the aggregate of loans raised in any one year under the powers conferred by this subsection shall not exceed the sum of twenty thousand pounds:
“Provided further that any such proposal shall be previously advertised by means of posters in the Board’s cars for at least twenty-eight days before the day fixed for the confirming of the resolution to raise such loan, and that the public notices required to be given in the making of special orders shall appear in at least two newspapers circulating in the district; and that, upon the presentation to the Board at any time prior to the time fixed for the confirming of such resolution of a petition signed by at least one thousand ratepayers requiring the Board to submit the proposed loan to the approval of the ratepayers, the Board shall hold a poll of the ratepayers before proceeding further in raising such loan.”
10 Dwellings for Board’s employees.
(1.)
In respect to all employees of the Board, but to no greater extent, all and singular the powers, authorities, and discretions conferred upon Borough Councils by Part XXXVII of the Municipal Corporations Act, 1920, are hereby conferred upon the Christchurch Tramway Board, and sections three hundred and twenty-nine to three hundred and thirty-three of that Act are hereby incorporated in and shall be read, mutatis mutandis, with the principal Act.
(2.)
For the purposes of this section the term “worker”
shall include every person, male or female, who is employed in work of any kind for the Board; and the word “Board”
shall be substituted for the word “Council”
wherever the latter word occurs throughout the said sections.
11 Unauthorized expenditure.
The Board may in every financial year expend for purposes not authorized by any Act or law for the time being in force any sum or sums not amounting in the whole to more than two hundred and fifty pounds; and this provision shall be read as if it had come into force upon the thirty-first day of March, nineteen hundred and twenty, so as to validate any unauthorized expenditure incurred since that date.
12 Subsidy to sick benefit society.
It shall be lawful for the Board to pay out of the Board’s fund to the Christchurch Tramway Employees’ Sick Benefit Society such sums of money as the Board may from time to time resolve to pay to such society by way of subsidy; and this provision shall be read as if it had come into force upon the thirty-first day of March, nineteen hundred and twenty, so as to authorize and validate any subsidy made by the Board to the society since that date.
