An Act to amend the Whangarei Borough Empowering Act, 1918.
Preamble.
WHEREAS the Whangarei Borough Council was authorized by the Whangarei Borough Empowering Act, 1918, to raise certain loans for the purpose of the formation and construction of certain private streets within such borough: And whereas in the public notice of the poll taken for the purpose of raising such loans, and which loans were duly raised, the sum of one thousand three hundred and twenty pounds was stated as required for Raumanga Road, one of the streets named as a private street in such Act: And whereas Raumanga Road is, and was at the time of the passing of such Act, a public street, and such loan is not now required for the purpose of forming and metalling such street, as such street has now been formed and metalled as a public street: And whereas it has been found that the moneys allocated for the purpose of forming and metalling the other private streets named in such Act are insufficient, and it is necessary to give power to the Whangarei Borough Council to apply such moneys towards the construction of such other private streets:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Whangarei Borough Empowering Amendment Act, 1922, and shall be read together with and deemed part of the Whangarei Borough Empowering Act, 1918.
2 Power to expend money raised on certain private streets.
(1.)
The said Council may allocate the said sum of one thousand three hundred and twenty pounds among those of the private streets named in the said public notice of poll for which the allocations made in the same public notice are, in the opinion of the said Council, insufficient, and the Council may make such allocation in such portions and manner as it thinks fit, and may expend the money so allocated upon the formation and the construction (including the construction of footpaths, kerbing, and channelling) of the said private streets respectively.

The said Council may impose annually upon the ratepayers within a separate or special area created with respect to any private street to which an allocation shall be made as aforesaid, proportionately to the unimproved value of their lands, a special rate in repayment to the said Council of one-half of the part of the said sum of one thousand three hundred and twenty pounds allocated to that private street, with interest thereon, until the loan for which the said poll was taken shall be repaid; such special rate to be in addition to any other special rate imposed upon the said ratepayers under the Whangarei Borough Empowering Act, 1918.
