An Act to vest Part of the Foreshore and certain Mud-flats within the Harbour of Whangarei, and situated on either Side of the Railway-line in the County of Whangarei, in the Whangarei Harbour Board.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

This Act may be cited as the Whangarei Harbour Board Vesting and Empowering Act, 1923.

2 Act deemed to be a special Act.

This Act shall be deemed to be a special Act within the meaning of the Harbours Act, 1908, and shall be read and construed along with the Whangarei Harbour Act, 1907.

3 Vesting lands in Board.

On the passing of this Act the lands described in the Schedule hereto, excepting any portion thereof which is Native land within the meaning of the Native Land Act, 1909, and any portion thereof reserved or set apart for the purposes of a Native fishing-ground and fisheries, shall vest in and be the property of the Whangarei Harbour Board as endowment lands:

Provided that nothing herein shall affect any rights or powers of the Crown, or shall interfere with existing riparian rights of His Majesty or of any other person.

Schedule

All those portions of land in the Whangarei Harbour in Block IX of the Whangarei Survey District, lying between high and low water at ordinary spring tides, adjoining the Hihiaua, Okara, and Raumanga No. 1 Blocks, Lot 186 of Allotment 1 of the Parish of Whangarei and railway reserves, the land to be vested being more particularly described hereunder, namely,—

All that parcel of land, containing 10 acres 1 rood 35 perches, more or less: bounded towards the north by the Hihiaua Block, 690 links; towards the north-east by a road 70–5 links, and 503.9 links by a creek, being the western boundary of the said road continued, and again by the said creek to the railway-line; thence towards the south-west by the railway-line, 2157.8 links; and towards the north-west by Lot 186, subdivision of Allotment 1, Parish of Whangarei, 425.44 links; and marked “M” upon the plan deposited in the office of the Marine Department, at Wellington, and marked M.D. 5701.

All that parcel of land, containing 7 acres 1 rood 16 perches, more or less: bounded towards the north-east by the said railway-line, 1244.8 links and 31.5 links; towards the south-east by Lot 8 and part Lot 7, subdivision of part of Raumanga No. 1 Block, 642.91 links; and generally towards the south-west by parts of Lots 7 and 6 of said subdivision, 600.82 links and 700 links; and towards the north-west by other part of said Lot 6, 373.41 links; and marked “N” upon a plan deposited in the office of the Marine Department, at Wellington, and marked M.D. 5701.
