An Act to effect an Exchange of certain Lands between the New Plymouth Borough Council and the New Plymouth Harbour Board.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the New Plymouth Borough and New Plymouth Harbour Board Exchange Act, 1924.
2 Interpretation.
In this Act—
“The Corporation of the borough” means the Corporation of the Mayor, Councillors, and Burgesses of the Borough of New Plymouth:
“Borough Council” means the New Plymouth Borough Council:
“Harbour Board” means the New Plymouth Harbour Board.
3 Exchange of lands between New Plymouth Borough Council and New Plymouth Harbour Board.
The land described in the First Schedule hereto (being land heretofore vested in the Corporation of the borough) is hereby vested in the New Plymouth Harbour Board in fee-simple (subject to any existing leases or other interests affecting the same), and shall be held by the Harbour Board upon the like trusts and for the same purposes as those upon or for which the lands described in the Second Schedule hereto were held by it immediately prior to the passing of this Act; and the land described in the Second Schedule hereto (being land heretofore vested in the Harbour Board) is hereby vested in the Corporation of the Borough of New Plymouth in fee-simple (subject to any existing leases or other interests affecting the same), and shall be held by the said Corporation upon the like trusts and for the same purposes as those upon or for which the lands described in the First Schedule hereto were held by it immediately prior to the passing of this Act.
4 District Land Registrar to cancel existing certificates of title and issue fresh certificates of title.
The District Land Registrar of the Land Registration District of Taranaki shall, upon application under the seal of the Borough Council and the Harbour Board respectively, cancel any existing certificates of title of the lands described in the First and Second Schedules hereto, and shall issue certificates of title for the said lands to the Borough Council and the Harbour Board respectively in accordance with the provisions of the last preceding section.
5 Harbour Board to pay equality of exchange.
Forthwith after the passing of this Act the Harbour Board shall pay to the Borough Council the sum of three hundred and sixty-seven pounds by way of equality of the exchange effected by this Act, and until paid the said sum shall be deemed to be a debt due by the Harbour Board to the Borough Council, and shall be recoverable in any Court of competent jurisdiction accordingly.
6 Application of equality of exchange by Borough Council.
The said sum of three hundred and sixty-seven pounds may be expended by the Borough Council only for the purpose of effecting improvements upon the lands vested in it pursuant to this Act.
7 Borough Council to keep separate account.
The Borough Council shall keep a separate account in its books showing the receipts and expenditure of all moneys received by it under the provisions of this Act.
SCHEDULES
FIRST SCHEDULE
All that area of land in the Borough of New Plymouth, containing 12·9 perches, be the same a little more or less, being Section 2338 on plan 1164· deposited in the office of the District Land Registrar at New Plymouth, and bounded towards the north by Allotment 41, Mount Eliot Harbour Reserve, 104 links; towards the west by deviation of Mangotuku Stream, 63·l links; towards the south by King Street, 107·95 links; and towards the east by Egmont Street, 92 links, as the said area is shown and delineated on plan marked M.D. 5892, and deposited in the office of the Marine Department at Wellington.
SECOND SCHEDULE
All that area of land in the Borough of New Plymouth, containing 1 rood 7·l perches, be the same a little more or less, being Allotments numbered 1, 2, 3, and 31 on plan 578, deposited in the office of the District Land Registrar at New Plymouth, and bounded towards the north by St. Aubyn Street, 218·38 links; towards the north-west by Queen Street, 16·87 links; towards the west by Queen Street, 230 links; towards the south and south-east by the Mangotuku Stream; and towards the east by Allotment 4 on deposited plan 578 aforesaid, 111·12 links, as the said area is shown and delineated on plan marked M.D. 5892, and deposited in the office of the Marine Department at Wellington.
