An Act to vest Part of the Foreshore within McCormack’s Bay, situated between the Christchurch and Sumner Main Road and the Christchurch Tramway Board’s Causeway, in the Corporation of the Borough of Sumner, and Part thereof in the Corporation of the County of Heathcote.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Sumner Borough and Heathcote County (McCormack’s Bay) Vesting Act, 1924.
2 Deemed a special Act.
This Act shall be deemed to be a special Act within the meaning of the Harbours Act, 1923.
3 Vesting lands in Corporations.
(1.)
On the passing of this Act the land described in the First Schedule hereto shall vest in and be the property of the Corporation of the Borough of Sumner, and the land described in the Second Schedule hereto shall vest in and be the property of the Corporation of the County of Heathcote.
(2.)
The lands vested pursuant to this section shall be held as reserves for the use, recreation, and enjoyment of the inhabitants of the Borough of Sumner and of the County of Heathcote respectively.
SCHEDULES
FIRST SCHEDULE
All that parcel of land, situate in Block 2 of the Sumner Survey District and Block 16 of the Christchurch Survey District, being part of McCormack’s Bay, in the Avon and Heathcote Estuary, containing 24 acres 2 roods 10 perches, more or less, and bounded as follows: commencing at a point distant 98.55 links from the Sumner Road Standard Survey Stone No. 28, and bearing 309° 49′ north-westerly therefrom; thence north-westerly by a line bearing 326° 32′ (true), 2701.7 links, to the southern side of the Christchurch Tramway Board’s causeway; thence south-easterly along the said causeway by line bearing 95° 09′, 2556 links, and 102° 41′, 220.4 links; and from thence returning along the south-east side of the said estuary, being the north-west side of the Christ-church and Sumner Main Road fronting thereon, to the commencing-point: as the said piece of land is more particularly delineated edged green on the plan deposited in the office of the Marine Department at Wellington, and marked M.D. 5818.
SECOND SCHEDULE
All that parcel of land, situate in Block 2 of the Sumner Survey District and Block 16 of the Christchurch Survey District, being part of McCormack’s Bay, in the Avon and Heathcote Estuary, containing 30 acres and 30 perches, more or less, and bounded as follows: commencing at a point distant 98.55 links from the Sumner Road Standard Survey Stone No. 28, and bearing 309° 49′ north-westerly therefrom; thence north-westerly by a line bearing 326° 32′ (true), 2701.7 links, to the southern side of the Christchurch Tramway Board’s causeway, and bearing 275° 09′, 2792–2 links, to the northern side of the Christchurch and Sumner Main Road, being the southern boundary of the said estuary opposite Rural Section 866; and from thence returning south-easterly and easterly along the north-eastern and northern side of the Christchurch and Sumner Main Road to the commencing-point: as the said piece of land is more particularly delineated edged in violet on the said plan M.D. 5818.
