An Act to vest the Control and Management in the Whangarei Harbour Board of the Harbours of Tutukaka, Whangaruru, and Whananaki, situate on the Eastern Coast of the Whangarei Harbour Board District.
Preamble
WHEREAS it is desirable that the management and control of the harbours of Tutukaka, Whangaruru, and Whananaki be vested in the Whangarei Harbour Board (hereinafter termed the Board):
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title
This Act may be cited as the Tutukaka, Whangaruru, and Whananaki Harbours Control Act, 1926.
2 Control of Tutukaka, Whangaruru, and Whananaki Harbours to vest in Board.
From and after the passing of this Act the harbours of Tutukaka, Whangaruru, and Whananaki, as the same are respectively defined in the Schedule hereto, shall be under the control and management of the Board, and the Board shall thereupon have and may exercise all the powers, authorities, functions, and jurisdiction in relation to the said respective harbours that it has or can or may exercise in relation to the Harbour of Whangarei under or by virtue of any statutory enactment for the time being in force, and shall also be subject to such duties in relation to the said Tutukaka, Whangaruru, and Whananaki Harbours as are imposed upon Harbour Boards by the provisions of such enactments.
3 Act to be deemed a special Act
This Act shall be deemed to be a special Act within the meaning of the Harbours Act, 1923, and shall be read with the said Act.
Schedule
Tutukaka Harbour
All that area, situated in Block IV of the Whangarei Survey District, in the County of Whangarei, bounded by a line commencing from the easternmost extremity of the Wharahewa Block at the line of mean high-water mark, and proceeding thence westerly, northerly, and easterly along the line of mean high-water mark in Tutukaka Harbour as far as the most easterly point of Section 1, Block IV, of the said survey district, and thence by a line in a southerly direction to the commencing-point in the said Wharahewa Block; and including within such area all bays, tidal streams, rivers, and inlets running or flowing into the said harbour up to the mean high-water mark: as the said area is shown and delineated on sheet 1 of plan marked M.D. 6209, and deposited in the office of the Marine Department at Wellington, and thereon coloured blue.
Whangaruru Harbour
All that area, situated within Blocks III and II of the Whangaruru Survey District and Blocks XII and VIII of the Russell Survey District, in the County of Whangarei, bounded by a line commencing at the north-eastern corner of Section 8, Block III, of the Whangaruru Survey District at the line of mean high-water mark, and proceeding thence northerly and north-westerly along the line of mean high-water mark in Whangaruru Harbour to the mouth of the Whangaroa Stream where it empties into the said Whangaruru Harbour; thence crossing the said stream in a direct line to the opposite bank on the Whangaroa-Ngaiotonga No. 4f Block; thence generally south-easterly along the line of mean high-water mark of the said Whangaruru Harbour to a point known as Cape Home, in the Papakura Native Block; thence southerly by a straight line to the eastern extremity of Henry Island; thence in a direct line south-westerly to the commencing-point; and including within such area all bays, tidal streams, rivers, and inlets running or flowing into said harbour up to the mean high-water mark: as the said area is shown and delineated on sheet 2 of plan marked M.D. 6209, and deposited in the office of the Marine Department at Wellington, and thereon coloured blue.
Whananaki Harbour
All that area, situated in Blocks VI and IX of the Opuawhanga Survey District, in the County of Whangarei, bounded commencing at the south-east corner of Section 26, Block IX aforesaid, and proceeding thence north-easterly generally along the line of mean high-water mark of the sea as far as Section 25 of said Block IX; thence westerly generally along the mean high-water mark of the Whananaki Harbour as far as Section 4, Block V, Opuawhanga Survey District; thence easterly generally along the left bank of the said Whananaki Harbour along the mean high-water mark thereof as far as Motutara Point; thence westerly again by a line from Motutara Point to the commencing-point; and including within such area all bays, tidal streams, rivers, and inlets running or flowing into the said Whananaki Harbour up to the mean high-water mark: as the said area is shown and delineated on sheet 3 of plan marked M.D. 6209, and deposited in the office of the Marine Department at Wellington, and thereon coloured blue.
