An Act to constitute the Te Matai Road Water-race District.
Preamble.
WHEREAS the area of land described in the Schedule hereto lies partly within the County of Tauranga and partly within the County of Rotorua: And whereas it is desirable that the said area be declared a water-race district, but there is no provision in the Water-supply Act, 1908, for the declaration of an area of land not lying wholly within one county to be a water-race district:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Te Matai Road Water-race District Act, 1927.
2 Interpretation.
In this Act, if not inconsistent with the context,—
“The general Act” means the Water-supply Act, 1908:
“The said district” means the Te Matai Road Water-race District constituted under this Act.
3 Constitution of district.
(1)
The area of land described in the Schedule hereto is hereby constituted and declared to be a water-race district under the general Act, to be called the Te Matai Road Water-race District, as if the whole of the said area of land were lying within the County of Tauranga and were a part of that county, and had been duly and validly declared a water-race district by the Tauranga County Council under the provisions of and in accordance with the general Act.
District to be under jurisdiction of Tauranga County Council.
(2)
The said district shall, for all the purposes of and incidental to the general Act and this Act, be under the exclusive jurisdiction of the Tauranga County Council as if the whole of the said district were within the County of Tauranga and were a part of that county.
4 Preparation of special rolls.
(1)
For the purposes of the Local Bodies’ Loans Act, 1926, the said district shall be deemed to be a defined part of the County of Tauranga; and in respect of the said district any special roll to be prepared under the provisions of subsection three of section three of the last-mentioned Act shall be prepared by the Tauranga County Council from the valuation rolls of the Tauranga County and the Rotorua County accordingly; and for that purpose, and for the purposes of the correction, completion, and authentication of the said special roll, the Tauranga County Council shall at all reasonable times have and be allowed access to the valuation roll of the Rotorua County.
Tauranga County Council may make and collect rates.
(2)
For all the purposes of and incidental to the general Act and this Act the Tauranga County Council may make and levy rates over all or any of the rateable lands within the said district, and may collect and recover the same in all respects as if the whole of the said district were within the County of Tauranga and were a part of that county.
5 Powers and duties conferred or imposed upon the Tauranga County Council.
For all the purposes of and incidental to the general Act and this Act the whole of the said district shall be deemed to be a part of the County of Tauranga; and the Tauranga County Council shall accordingly, in and in respect of the said district, have and may exercise all the rights, powers, and privileges, and shall be subject to the duties and liabilities, vested in or conferred or imposed upon County Councils by the general Act or this Act, anything in the general Act or any other Act to the contrary notwithstanding.
6 Extension of meaning of term “preliminary expenses”
as used in Local Bodies’ Loans Act, 1926.
In respect of the first special loan that is raised by the Tauranga County Council under the authority conferred upon it by the general Act and this Act, the term “preliminary expenses”
as used in paragraph (a) of subsection one of section five of the Local Bodies’ Loans Act, 1926, shall, without restricting the meaning of that term as so used, be interpreted and construed as including—
(a)
All costs, fees, charges, and expenses incurred, paid, or payable by the promoters of this Act, or by the Tauranga of the Rotorua County Council, in or incidental to the preparation, promotion, and enactment of this Act; and also
(b)
The costs, fees, charges, and expenses incurred, paid, or payable by the Tauranga County Council in or incidental to obtaining the consent of the ratepayers to the raising of that special loan.
Schedule
All that area of land situated in the Auckland Land District bounded as follows, that is to say: Commencing at a point on the Te Matai Road being the northernmost corner of Lot 8 of a subdivision of Rangiuru No. 3 shown on deposited plan 1950; thence in a south-easterly direction along the north-eastern boundary of the said Lot 8 to a stream; thence by that stream in a south-westerly direction forming the boundary of Lots 8, 6, and 3 of the said subdivision until its intersection with the north-western boundary of Rangiuru No. 2d No. 2; thence along the north-western and north-eastern boundaries of Rangiuru No. 2d No. 2, Rangiuru No. 2d No. 1a, and again of Rangiuru No. 2d No. 2 to Section 12, Block X, Maketu Survey District; thence by the north-eastern boundary of the said Section 12 to a road reserve; thence by the said boundary-line produced to the Mangorewa River; thence following that river in a south-westerly direction to the southernmost corner of Section 7, Block XIII, Maketu Survey District; thence northerly by the western boundary of the said Section 7 to Section 6 of Block XIII, Maketu Survey District; thence westerly by the south-eastern and south-western boundaries of the said Section 6 to a public road; thence by the last-mentioned boundary-line produced across such road; thence in a south-westerly direction along such road to the southern corner of Section 15, Block XVI, Otanewainuku Survey District; thence by the south-western boundary of the said Section 15 to the Whataroa Stream; thence by that stream in a north-easterly direction to the northern corner of Section 9, Block XIII, Maketu Survey District; thence in a south-easterly direction along the boundary of the said Section 9 to Section 8, Block XIII, Maketu Survey District; thence along the whole of the north-western boundary of the said Section 8 to the Whataroa Stream; thence in a north-easterly direction along the Whataroa and Waiari Streams to the intersection of the north-eastern boundary of Lot 7 of Rangiuru No. 3 aforesaid; thence in a south-easterly direction along the boundary of the said Lot 7 to a public road (being the Te Matai Road); thence across such road to the point of commencement
