An Act to enable the Auckland City Council to take over and declare to be a Public Street a certain Strip of Land leading from Remuera Road to certain Sections of Land on Mount Hobson within the City of Auckland.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

This Act may be cited as the Auckland City Empowering Act, 1928.

2 Council may take over land and declare same a public street.

The Auckland City Council is hereby authorized to take over and declare to be a public street the piece of land described in the Schedule hereto upon such terms as to formation and otherwise as the Council requires; and upon the Council lodging in the office at Auckland of the Registrar of Deeds or the District Land Registrar, as the case may be, a certificate under the seal of the Council that the said piece of land has been so taken over by it the same shall be and be deemed to be a public street and to be vested in the Corporation of the City of Auckland as such.

Schedule

All that area of land in the North Auckland Land District, situated in Block VIII, Rangitoto Survey District, being part of Allotment 3, Section 11, Suburbs of Auckland, containing by admeasurement 1 rood 13 perches, more or less: Bounded—commencing at the north-westernmost point of the land comprised in certificate of title, Volume 133, folio 111, Auckland Registry; on the north-east by the southern alignment of Remuera Road, 364 links; thence on the south-east by Lot 1 of Allotment 3 aforesaid, 229.9 links; thence on the north by Lots 1, 2, 3, and 4 of Allotment 3 aforesaid, 443.6 links; thence on the east by part Allotment 3, 36–4 finks; thence on the south by other part of Allotment 3 aforesaid, 479–8 links; and thence on the west by other part of Allotment 3 aforesaid, 266–4 links, to the point of commencement.
