An Act to enable the Chairman, Councillors, and Inhabitants of the County of Buller to lease Section No. 281, Town of Millerton, to the Millerton Miners’ Union.
Preamble.
WHEREAS by section fifty of the Reserves and other Lands Disposal and Public Bodies Empowering Act, 1920, Section No. 281 on the plan of the Town of Millerton, in the County of Buller, was vested in the Chairman, Councillors, and Inhabitants of the County of Buller (hereinafter called “the Council”
) in trust for public purposes subject to certain rights of user by the Defence Department: And whereas the Millerton Miners’ Union desire to take a lease of the said land for the purpose of erecting a hall thereon for the use, enjoyment, and recreation of the inhabitants of the said Town of Millerton: And whereas it is necessary to give the Council full powers to enable the leasing of the said land to the said miners’ union:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Buller County Leasing Empowering Act, 1928.
2 Power to lease.
The Council is hereby empowered to lease the said section to the said miners’ union by private treaty and upon such terms and conditions as may be approved by the Governor-General, including the reservation of a nominal rental.
3 Freehold retained.
The freehold of the said land shall remain vested in the Council.
4 Hall to be erected.
Such lease shall be for the purpose of erecting on the said section a hall for the use, enjoyment, and recreation? of the inhabitants of the Town of Millerton.
5 Rights of Defence Department.
The said hall shall nevertheless be available for and may be used by the New Zealand Defence Department or military authorities for military purposes free of charge at any time when so required on one month’s notice being given to the officials of the said miners’ union:
Provided that the number of occasions on which it may be so used shall not exceed one night per week and twelve half-days in any year.
6 Term of lease.
The lease shall take effect within a period of three months from the date of the passing of this Act, and shall be for a term not exceeding forty-two years.
