Contents
An Act to enable the Onerahi Town Board to apply the Revenue from the Water Reserve, being Sections 239 and 240 of the Parish of Owhiwa, towards financing the Present Water-supply of the said Town Board, and to enable the said Town Board to clear the said Land of a Proportion of Bush and convert same into Pasture and lease the said Land.
Preamble
Whereas the said sections of land were by Order in Council bearing date 21 August 1922, vested in the Onerahi Town Board as a reserve for water-conservation purposes:
And whereas in the preparation of a scheme for supplying water to the Town District of Onerahi from the said sections of land it was found that the cost would be very great, and the Engineer of the Board after consultation with other Engineers advised the Board that it would be a better and cheaper scheme to connect up with the Whangarei Borough Council’s water-supply mains, which was accordingly done:
And whereas the said Town Board desire to extend the usefulness of the said sections 239 and 240 by obtaining authority to clear and lay down in pasture a portion of the said land, and to lease the said land and apply the income thence derived towards the upkeep and cost of maintenance of the present water-supply so derived from the Whangarei Borough Council:
1 Short Title
This Act may be cited as the Onerahi Water Reserve Enabling Act 1928.
2 Power to clear sections and lay down in pasture
It shall be lawful for the body corporate known as the Onerahi Town Board (hereinafter called the Board) to clear such parts of sections 239 and 240 of the Parish of Owhiwa as the said Board shall deem advisable of the bush now standing or being thereon, and to lay the land so cleared down in pasture.
3 Power to let or lease
The said Board may let or lease the said land, either in one or more lots, for such term of years and upon such conditions as are prescribed in and by the Public Bodies Leases Act 1908.
4 Rents to be applied for maintenance of water-supply
The rents and revenue derived from the said lands shall, after paying all lawful charges in respect of the said lands, be applied by the said Board in and towards financing the said Board in the payment for and maintenance and up-keep of the water-supply now derived from the Whangarei Borough Council.
