An Act to authorize the Hawke’s Bay County Council to purchase a Leasehold Interest in a certain Parcel of Land and Building and to grant Leases of the Same and an adjoining Parcel of Land and Building.
Preamble.
WHEREAS by memorandum of lease bearing date the eighth day of December, nineteen hundred and twenty-eight, registered in the Land Transfer Office at Napier under Number 7164, made between His Majesty the King of the one part and the New Zealand Shipping Company, Limited (hereinafter called the said company), of the other part, His Majesty the King leased to the said company the parcel of land described in the First Schedule hereto for the term, at the rent, and upon and subject to the conditions and provisions therein appearing: And whereas by deed of lease bearing date the seventeenth day of September, nineteen hundred and nine, registered in the Deeds Register Office at Napier under Number 42655, made between the School Commissioners for the Provincial District of Hawke’s Bay of the one part and the Corporation of the Chairman, Councillors, and Inhabitants of the County of Hawke’s Bay (herein after called the Corporation) of the other part, the said School Commissioners leased to the Corporation the parcel of land described in the Second Schedule hereto for the term, at the rent, and upon and subject to the conditions and provisions therein contained, and together with a right of renewal which has already been exercised by the Corporation: And whereas the said parcels of land adjoin each other, and standing on such parcels of land is a building which forms one structure without any continuous wall or other division between the respective portions standing on each of the said parcels of land: And whereas portion of the said building is used by the Corporation for offices and other purposes connected with the business of the Corporation: And whereas it is advisable that the Council of the Hawke’s Bay County shall acquire on behalf of the Corporation the estate and interest in the said parcel of land described in the First Schedule hereto and the building thereon held by the said company under and by virtue of the said memorandum of lease, registered number 7164, and that the said Council shall have the power of leasing the said parcels of land and the buildings thereon or any portion or portions thereof:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Hawke’s Bay County Empowering Act, 1930.
2 Authority to purchase leasehold.
The Council of the Hawke’s Bay County is hereby authorized to purchase on behalf of the Corporation the estate and interest of the said company or its assigns in and to the said parcel of land described in the First Schedule hereto and the buildings thereon held by the said company under and by virtue of the said memorandum of lease, registered number 7164 (subject to any existing tenancies), at such price, and upon and subject to such terms and conditions as may be agreed upon between the said Council and the said company or its assigns.
3 Authority to exercise rights of renewal.
The said Council is hereby authorized to exercise all or any of the rights of renewal and other rights conferred on the lessee under the said leases respectively.
4 Authority to grant leases.
The said Council is hereby authorized, after it shall have purchased the estate and interest aforesaid in the said parcel of land described in the First Schedule hereto, to let and grant leases of the parcels of land described in the First and Second Schedules hereto and the buildings standing thereon, or any portion or portions of such lands or buildings, with the consent of the Land Board at such rent, for such term, and upon and subject to such conditions and provisions as the said Council may think fit.
SCHEDULES
FIRST SCHEDULE
All that parcel of land containing 5·94 perches, more or less, being portion of Town Section 142, Borough of Napier, as shown as Lot 2 on a plan deposited in the Land Transfer Office at Napier under No. 3523.
SECOND SCHEDULE
All that parcel of land containing 5·93 perches, more or less, being portion of Town Section 142, Napier, as shown as Lot 1 on a plan deposited in the Land Transfer Office at Napier under No. 3523.
