An Act to validate certain Irregular Proceedings in connection with the Construction by the New Lynn Town Board of a Sewerage System.
Preamble.
WHEREAS in the year nineteen hundred and twenty-seven the New Lynn Town Board commenced the construction of a sewerage system (hereinafter referred to as the said system) for the drainage of the New Lynn Town District: And whereas before proceeding to construct the said system certain steps were taken purporting to comply with the provisions (particularly section two hundred and nineteen, and the Eighth Schedule) of the Municipal Corporations Act, 1920, as incorporated in the Town Boards Act, 1908 (hereinafter referred to as the said provisions): And whereas the steps so taken did not comply in all respects with the said provisions, and it is desirable to validate the same: And whereas the area of the said New Lynn Town District has been constituted a borough since the commencement of the said system:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the New Lynn Sewerage Validation Act, 1931.
2 Interpretation.
In this Act “Council”
means and includes both the New Lynn Town Board and the New Lynn Borough Council.
3 Steps validated.
The Council shall for all purposes be deemed to have been as lawfully empowered to construct the said system and every part thereof as if all the requirements of the said provisions had been duly complied with.
