An Act to extend the Leasing-powers of the Trustees of the Cameron and Soldiers’ Memorial Park at Masterton.
Preamble.
WHEREAS pursuant to and subject to the terms of a certain declaration of trust under the seal of the Masterton Trust Lands Trustees (hereinafter referred to as the trustees) and bearing date the twentieth day of December, nineteen hundred and twenty-six, the parcel of land described in the Schedule hereto is now vested in the trustees, under the name “The Cameron and Soldiers’ Memorial Park”
, as a memorial of those who lost their lives in the Great War of nineteen hundred and fourteen to nineteen hundred and eighteen, for the purposes of a park or sports-ground for the use and benefit of the Small-farm Settlement of Masterton and the Borough of Masterton and the inhabitants thereof, and for the purpose of promoting, fostering, and encouraging, in the Small-farm Settlement of Masterton and in the Borough of Masterton, sports, games, and pastimes of all kinds, and increasing and improving facilities therefor, and assisting clubs and associations in the Small-farm Settlement of Masterton and the Borough of Masterton formed for the purpose of promoting or fostering any form of sports, games, or pastimes: And whereas the leasing-powers vested in the trustees by virtue of the said declaration of trust require that every lease of the said parcel of land, or any part thereof, shall be upon terms requiring that all revenue derived by the lessee from the use of the property leased shall be applied towards the upkeep and improvement of the said lands, or towards the promotion of sport in the Small-farm Settlement of Masterton and the Borough of Masterton exclusively, or towards the other purposes mentioned in the said declaration of trust, and upon other terms more particularly set out in the said declaration of trust: And whereas it is found that the restrictions imposed by the said declaration of trust on the leasing-powers of the trustees render impracticable the attainment of the objects set out in the said declaration of trust, and it is desirable to extend those powers in the manner hereinafter set forth:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same as follows:—
1 Short Title.
This Act may be cited as the Cameron and Soldiers’ Memorial Park (Masterton) Trustees Empowering Act, 1931.
2 Leasing-powers of trustees.
(1)
Notwithstanding anything to the contrary in the above-mentioned declaration of trust contained, the trustees shall have power from time to time, and at any time or times, to grant leases and tenancies of the parcel of land described in the Schedule hereto, or of any part or parts thereof, in favour of any lessee or lessees, or tenant or tenants, in whose favour the trustees might heretofore have granted such leases or tenancies, but without the necessity of imposing any condition or making any stipulation whatsoever as to the disposal or application by any such lessee or tenant of any revenue or moneys derived by such lessee or tenant from the use of any property included in the lease or tenancy so granted to such lessee or tenant.

Save as in this section otherwise expressly provided, every lease and every tenancy of the said parcel of land, or any part thereof, hereafter granted by the trustees shall be so granted in accordance and compliance with the provisions of the said declaration of trust.
Schedule
All that parcel of land situate in the Wellington Land Registration District, and containing 14 acres 2 roods 28·5 perches, more or less, and being part of Sections 2 and 3 of the Masterton Small-farm Settlement, and being the whole of the land comprised in the certificate of title recorded in Volume 304, folio 128, of the register-books of the District Land Registrar at Wellington.
