An Act to authorize the Hawke’s Bay County Council to take a Lease of certain Parcels of Land and to grant Subleases of the Same and to acquire certain Rights-of-way.
Preamble.
WHEREAS the parcels of land described in the Schedule hereto are vested in His Majesty the King: And whereas the Corporation of the Chairman, Councillors, and inhabitants of the County of Hawke’s Bay (hereinafter called the Corporation) hold a lease of adjoining lands with the buildings thereon: And whereas, in order that provision may be made for the future office and business requirements of the Corporation, the Hawke’s Bay County Council desires to acquire on behalf of the Corporation a lease of the said parcels of land described in the Schedule hereto: And whereas it is desirable that the said Council shall have the power of subleasing the said parcels of land and the buildings thereon or any portion or portions thereof:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Hawke’s Bay County Empowering Act, 1935.
2 Authority to acquire lease.
The Council of the Hawke’s Bay County is hereby authorized to take, on behalf of the Corporation, a lease of the said parcels of land described in the Schedule hereto or any portion thereof and the buildings thereon for such term, with or without rights of renewal, at such rental, and upon and subject to such terms and conditions as may be agreed upon.
3 Authority to acquire rights-of-way.
The Council is hereby authorized to acquire by lease, purchase, or otherwise rights-of-way over land contiguous to the said parcels of land.
4 Authority to grant subleases.
The said Council is hereby authorized, after it shall have taken a lease of the said parcels of land or any portion thereof, with the consent of the Land Board as provided by the lease, to let or grant subleases of the same and the buildings now or hereafter standing thereon or any portion or portions of such land or buildings, if at any time the same may be unoccupied by the said Council, at such rent, for such term, and upon and subject to such conditions and provisions as the said Council may think fit.
5 Authority to build.
The said Council is hereby authorized to expend moneys in the reinstatement of and making suitable for use the building at present standing on the said parcels of land or in the erection of a new building thereon.
Schedule
Firstly, all those parcels of land situate in the Borough of Napier, containing by admeasurement seven decimal five four perches (7·54 perches), more or less, being part of Town Section 142, Town of Napier, being also Lots three (3) and four (4) on Deposited Plan 3523, and comprising all the land in certificates of title, H.B. Volume 56, folios 54 and 55, Hawke’s Bay Registry.
Secondly, all that parcel of land situate in the Borough of Napier, containing approximately decimal seven four five of a perch (0·745 perches), being part of Town Section 142, being part of Lot seven (7) on Deposited Plan 3523, comprising part of the land in certificate of title, H.B. Volume 56, folio 58, Hawke’s Bay Registry: Bounded on the north by Lots three (3) and four (4) on the said deposited plan, on the east by Lot two (2) on the said deposited plan, on the south by part Town Section 141, Town of Napier, and on the west by a line in the same line as and continued from the western boundary of the said Lot four (4) through the said Lot seven (7) to the southern boundary thereof.
