An Act to confer Special Powers on the Thames Valley Drainage Board.
Preamble.
WHEREAS it is incumbent on the Thames Valley Drainage Board to execute necessary drainage-works for the special benefit of particular portions of the Board’s district: And whereas the Board is unable to pay the cost thereof out of general rate, but it is expedient that such and similar drainage-works shall be effected:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Thames Valley Drainage Board Empowering Act, 1937.
2 Board by special order may make separate rates in defined portions of the district.
Where it appears to the Board that any necessary drainage-work is for the special benefit of any particular portion of the Board’s district, and that the cost thereof cannot be defrayed out of general rate, the Board may, for defraying such cost, by special order defining the particular portion referred to, make and levy separate rates upon all property liable to be rated under the Land Drainage Act, 1908, within the portion so defined.
3 Separate rate may be annually recurring.
Any such separate rate may be made as an annually recurring rate, leviable year by year, without further proceeding on the part of the Board, until the drainage-work for the execution whereof the rate was made is completed.
4 Limitation of rates.
Such separate rate levied for any one year shall not exceed one halfpenny in the pound on the rateable capital value of the property liable to be rated, and the total amount of the Board’s general and separate rates together in any one year shall not exceed twopence in the pound on the said rateable capital value.
5 Rates on graduated scale according to classification.
The said separate rates shall be levied on a graduated scale according to a special classification of the lands affected, made by the Board for the purpose of such separate rates, and upon and subject to the classification provisions of the Land Drainage Act, 1908.
6 Costs deduction.
From the proceeds of every such separate rate there may be deducted such sum as in the opinion of the Board is necessary to defray the cost of making and levying the rate, and of the supervision and clerical work necessary in connection with the expenditure thereof, and the amount so deducted shall form part of the ordinary revenue of the district.
7 Application of rates.
The remainder of the separate rate shall be applied towards the cost of the drainage-work for the execution whereof it was levied.
