An Act to amend the Tauranga County Council Empowering Act 1952.
Preamble.
WHEREAS by section two of the Tauranga County Council Empowering Act 1952 the expression “special farm land”
means (inter alia) land which for the time being is shown on the valuation roll for the time being in force as having an area of not less than three acres: And whereas it is desirable that such minimum area should be reduced:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title.
This Act may be cited as the Tauranga County Council Empowering Amendment Act 1955, and shall be read together with and deemed part of the Tauranga County Council Empowering Act 1952 (hereinafter referred to as the principal Act).
2 Definition of “special farm land”
amended.
Section two of the principal Act is hereby amended by omitting from paragraph (d) of the definition of the expression “special farm land”
the words “three acres”
, and substituting the words “one and a half acres”
.
3 Special provision for year ending 31 March 1956.
In order to give effect to the intention of this Act in respect of general rates levied or to be levied by the Council for the year ending on the thirty-first day of March, nineteen hundred and fifty-six, the following provisions shall apply:
(a)
The Council may cause to be prepared and deposited, not later than the thirty-first day of December, nineteen hundred and fifty-five, a supplementary special farm-land list relating to all pieces of special farm land of not less than one and a half acres and less than three acres in area:
(b)
The provisions of sections three to six of the principal Act shall apply, as far as they are applicable and with the necessary modifications, to the supplementary list as if references in those sections to the special farm-land list were references to the supplementary list:
(c)
When the supplementary list is signed in accordance with those sections it shall be deemed for the purposes of this section and of the principal Act to be part of the special farm-land list made under the principal Act for the year ending on the thirty-first day of March, nineteen hundred and fifty-six:
(d)
The Council shall have power to refund to any occupier whose name appears in the supplementary list any amount paid by him in excess of the amount properly payable for the aforesaid year in respect of any property described in the supplementary list:
(e)
The power of correction given to a local authority by section fifty-seven of the Rating Act 1925 shall extend and apply to the modification of any rate demand for the year ending on the thirty-first day of March, nineteen hundred and fifty-six, issued before the signing of the supplementary list.
