An Act to vest certain lands in the Mayor, Councillors, and Citizens of the City of Nelson as a public street; and to authorise and validate certain expenditure by the Council

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Nelson City Empowering Act 1958.

2 Vesting certain lands in Corporation for public street

Whereas for many years there have been used by the public as a highway certain lands in the City of Nelson known as Harley and St. John Streets, and application has been made by the Nelson City Council for an Order in Council vesting such lands in the Corporation as and for streets: And whereas such proposed streets are less in width than the minimum of forty feet permitted by section one hundred and eighty-six of the Municipal Corporations Act 1954: Be it therefore enacted as follows:

(1)

Notwithstanding anything in any enactment relating to the width of streets, the lands hereinafter described are hereby vested in the Mayor, Councillors, and Citizens of the City of Nelson as and for a public street.

(2)

The lands referred to in subsection one of this section are all those pieces of land, situated in the City of Nelson, delineated on the plan numbered S.O. 10022 lodged in the office of the Chief Surveyor at Nelson, being—

(a)

Part of Section 177, M.R., containing four perches and eight-tenths of a perch, more or less, and coloured orange on the said plan;

(b)

Part of Section 176, containing four perches and eight tenths of a perch, more or less, coloured blue on the said plan, and being the whole of the land com prised in certificate of title, Volume 74, folio 156, Nelson Registry;

(c)

Part of Section 176, containing five one-hundredths of a perch, more or less, coloured sepia on the said plan, and being part of the land comprised in certificate of title, Volume 74, folio 155, Nelson Registry;

(d)

Part of Section 179, containing two perches and nine-tenths of a perch, more or less, coloured sepia on the said plan, and being the balance of the land comprised in deeds index, Volume 6, folio 32, Nelson Deeds Registry; and

(e)

Part of Section 178, containing thirty-four perches and four-tenths of a perch, more or less, coloured orange on the said plan, and being part of the land com prised in deeds index, Volume 1, folio 680, Nelson Deeds Registry.

3 Power to make grants to Nelson Public Relations Organisation Incorporated

The Nelson City Council is hereby authorised to make grants not exceeding five hundred pounds in each year to the Nelson Public Relations Organisation Incorporated.

4 Expenditure on centenary of city and on a coat of arms

The Nelson City Council is hereby authorised to expend money not exceeding the sum of seven hundred and fifty pounds out of its general fund or account towards celebrating and commemorating the hundredth anniversary of the granting of letters patent to the Diocese of Nelson, which ordained that the Town of Nelson should be a city, and for the expenses of and incidental to the designing of a coat of arms and registering the same with the Royal College of Heralds.

5 Expenditure on Stoke sewerage scheme

The Nelson City Council is hereby authorised to refund to its District Fund Account out of the proceeds of any portion of the Stoke Sewerage Loan 1958 (£160,000) any money expended from that account for the purposes for which the loan was sanctioned.
