An Act to empower the Southland Harbour Board to raise a loan for preliminary investigations and works for the provision of port facilities for an aluminium smelter at or in the vicinity of Bluff and further loans for harbour works authorised in 1952 and 1958

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Southland Harbour Board Empowering Act 1961.

2 Special Act

This Act shall be deemed to be a special Act within the meaning of the Harbours Act 1950.

3 Interpretation

In this Act, unless the context otherwise requires, the term “Board” means the Southland Harbour Board.

4 Power to raise loans

(1)

It shall be lawful for the Board from time to time, as it may require, to borrow, subject to the provisions of the Harbours Act 1950 and the Local Authorities Loans Act 1956, the following sums (in addition to any money authorised to be borrowed by the Board under or by virtue of any other Act), namely—

(a)

A sum or sums not exceeding in the whole fifty thousand pounds for the purpose of preliminary works and investigations for the provision of port facilities for an aluminium smelter to be established at or in the vicinity of Bluff:

(b)

A sum or sums not exceeding three hundred and twenty-five thousand pounds for the purpose of completing any of the works (except the Marine Airport) specified in the first column of the First Schedule to the Bluff Harbour Improvement Act 1952:

(c)

A sum or sums not exceeding two hundred and fifty thousand pounds for the purpose of the works firstly specified in the Schedule to the Southland Harbour Board Act 1958.

(2)

Any money borrowed under paragraph (b) of subsection (1) of this section shall be applied and expended in accordance with subsection (2) of section 4 of the Bluff Harbour Improvement Act 1952 for the purpose of the works (except the Marine Airport) specified in the first column of the said First Schedule; and subject to the provisions of this section the provisions of that subsection shall apply accordingly.
