An Act to extend the powers of the Christchurch City Council to establish, operate, and manage an information centre
WHEREAS the Mayor, Councillors, and Citizens of the City of Christchurch are registered as proprietors of an estate in fee simple in the land known as Queen Elizabeth II Park situated in the City of Christchurch: And whereas the said land is held for the purposes of section 305 of the Municipal Corporations Act 1954: And whereas it is desired to establish and operate an information centre on the said land:
BE IT THEREFORE ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Christchurch City Empowering (Information Centre) Act 1974.
2 Interpretation
In this Act, unless the context otherwise requires,—
“City” means the City of Christchurch:
“Council” means the Christchurch City Council.
3 Council may operate information centre
In addition to the powers conferred on the Council by the Municipal Corporations Act 1954 and other Acts, the Council is hereby authorised and empowered to establish, operate, and manage at Queen Elizabeth II Park an information centre to promote the advancement and development of the city or of any area or areas whose advancement or development would or might tend to benefit the city and to educate and instruct the public concerning the activities of the city or any such area or areas.
4 Additional powers of Council in respect of information centre
Without limiting the generality of section 3 of this Act, and in addition to the powers conferred on the Council by the Municipal Corporations Act 1954 and other Acts, the Council is hereby authorised and empowered, as part of the activities of such information centre,—
(a)
To buy and sell maps, postcards, photographic transparencies, films, souvenirs, and gift items:
(b)
To act as agent for the sale of tickets for scenic tours and flights, and to receive commissions for so doing:
(c)
To act as agent for the proprietors of accommodation houses of any kind for the booking of accommodation, and to receive from such proprietors a fee for so doing:
(d)
To let advertising space in the information centre authorised by section 3 of this Act and in any hand-books, abstracts, or other publications published by the Council pursuant to section 305(1)(f) of the Municipal Corporations Act 1954, and to receive payment therefor.
5 Council to keep accounts
(1)
For the purposes of this section, the term “undertaking”
means the information centre.
(2)
The Council shall—
(a)
Keep a Works and Services Account for the undertaking in accordance with section 127 of the Municipal Corporations Act 1954:
(b)
Prepare a statement showing its income and expenditure in respect of the undertaking for the financial year that ended on the preceding 31st day of March, and also a balance sheet in respect of the undertaking as at the end of that financial year:
(c)
Establish a renewal or depreciation fund in respect of the undertaking as if the undertaking were a trading undertaking within the meaning of Part XI of the Municipal Corporations Act 1954, and the provisions of that Part shall, with any necessary modifications, apply accordingly.
6 Revocation of regulations
The Christchurch City (Information Centre) Regulations 1973 are hereby revoked.
