An Act to change the name of the Napier Harbour Board to the Hawke’s Bay Harbour Board
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Hawke’s Bay Harbour Board Act 1974.
(2)
This Act shall come into force on the 1st day of April 1975.
2 Change of name of board
(1)
The Napier Harbour Board shall hereafter be called the Hawke’s Bay Harbour Board.
(2)
The Hawke’s Bay Harbour Board is hereby declared for all purposes to be the same body corporate as the Napier Harbour Board existing immediately before the commencement of this Act.
(3)
The First Schedule to the Harbours Act 1950 is hereby amended by omitting from the first column the words “Napier Harbour Board”
, and substituting the words “Hawke’s Bay Harbour Board”
.
(4)
Section 4 of the Trustee Act 1956 is hereby amended by omitting from subsection (1)(d) the words “the Napier Harbour Board”
, and substituting the words “the Hawke’s Bay Harbour Board”
.
(5)
All other references to the Napier Harbour Board in any Act, Proclamation, regulation, rule, bylaw, agreement, deed, instrument, title, licence, register, list, roll, rate book, or other document whatsoever, shall, unless the context otherwise requires, hereafter be read as references to the Hawke’s Bay Harbour Board.
3 Alteration of registers and registration of documents
(1)
Where the name of the Napier Harbour Board is entered in any register required by law to be kept, the Registrar or other person whose duty it is to keep that register may by virtue of this Act, and shall on the request in writing of the Hawke’s Bay Harbour Board and on the registration of such documents as the Registrar or other person may require, make such entries in the register and generally do all such other things as may be necessary to give effect to the provisions of this section.
(2)
The presentation to any such Registrar or other person of any instrument—
(a)
Properly executed or purporting to be properly executed by the Hawke’s Bay Harbour Board; and
(b)
Relating to any property registered in the name of the Napier Harbour Board—
shall be sufficient evidence of the vesting in the Hawke’s Bay Harbour Board of the property concerned and of the Board’s authority to execute the instrument.
