An Act to amend the Napier Gas Company’s Act, 1875, and the Napier Gas Company’s Act 1875 Amendment Act, 1885, and to enlarge the Scope thereof.
Prreamble.
WHEREAS it is expedient to amend the Napier Gas Company’s Act, 1875 (hereinafter called the principal Act), and the Napier Gas Company’s Act 1875 Amendment Act, 1885 (hereinafter called the Amendment Act), so as to vary and enlarge the powers and authorities of the Napier Gas Company, Limited (hereinafter called the Company), thereunder:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Napier Gas Company Amendment and Enlargement Act, 1936.
2 Construction of preamble of principal Act.
The preamble of the principal Act shall be read and construed as if the object of that Act were, amongst other things, to enable the company to do, effect, and carry out the various things therein specified and thereby contemplated, not only within the limits of the Town of Napier, but within the extended limits hereby authorized.
3 Addition to section 3 of principal Act.
There shall be added to section three of the principal Act the following provision—namely, “And the company shall also have, possess, and may exercise the like powers and authorities as aforesaid in respect of the several streets, roads, and bridges outside the limits of the Town of Napier, but within a radius of ten miles from the site of the present gasworks of the company situate in Sale Street in the Town of Napier”

4 Powers of company extended.
By the combined effect of the principal Act, the Amendment Act, and this Act, the company is hereby authorized and empowered—
(a)
To construct and lead a high- or low-pressure main from its Napier gasworks to, or connecting with, its gas-mains in the Borough of Hastings, or the reticulation connected therewith, and thereby to supply the Town of Hastings and “the surrounding districts”
as defined in the Amendment Act, and the inhabitants thereof respectively, with gas manufactured and produced at the gasworks of the company in the Town of Napier or in any place in the vicinity of that town at which its gasworks shall for the time being be situate:
(b)
By means of the high- or low-pressure main aforesaid, or the reticulation connected therewith for the purpose of the supply of gas within the Town of Napier and the extended limits hereby authorized, to supply the Town of Napier and the extended limits aforesaid, and the inhabitants thereof respectively, with gas manufactured and produced at the gasworks of the company in the Town of Hastings.
5 Validation of certain acts of company.
Any act, proceeding, or thing heretofore done or entered into by the company, whereby, or by means whereof, the company has been, or is, supplying inflammable air or gas to any place, town, locality, or district, or the inhabitants thereof, outside the limits prescribed by the principal Act, but within the extended limits hereby authorized, is hereby validated.
6 Interpretation.
The expression “Town of Hastings”
as used in the Amendment Act shall apply to the Borough of Hastings as constituted under the Municipal Corporations Act, 1933, or Acts thereby consolidated, and the expression “Corporation of the Town of Hastings”
as therein used shall have a corresponding meaning.
7 Private Act.
This Act shall be deemed to be a private Act.
