An Act to amend the Church Property Trust (Canterbury) Act 1879 to provide that payments to the Bishop of Christchurch from the income of the Bishopric Estate and payments to the Dean of Christchurch and Canons of the Christchurch Cathedral from the income of the Dean and Chapter Estate shall cease to be paid without deduction therefrom.
Preamble.
WHEREAS by the Church Property Trust (Canterbury) Act 1879 (hereinafter referred to as the principal Act) it was enacted that certain payments to the Bishop of Christchurch, the Dean of Christchurch, and Canons of the Christchurch Cathedral were to be made without deduction therefrom and that certain taxes thereon were to be paid out of the income of the respective funds from which such payments were directed to be made: And whereas the Synod of the Diocese of Christchurch, by resolution, has approved the introduction of a Bill so to amend the principal Act as to provide that such payments shall cease to be paid without deduction therefrom to the intent that the payment of taxes will in future be the responsibility of the recipients of such payments: And whereas it is desired that such amendment shall operate as from the first day of November, nineteen hundred and fifty-one, being the day upon which the Fourth Bishop of Christchurch entered upon his episcopal jurisdiction and therefore a convenient day upon which such amendment shall become operative: And whereas it is expedient that all costs, charges, and expenses of and incidental to the preparing, obtaining, and passing of this Act should be paid out of the income of the Bishopric Estate and out of the income of the Dean and Chapter Estate in equal shares:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Church Property Trust (Canterbury) Amendment Act 1951.
2 Section 8 of Church Property Trust (Canterbury) Act 1879 amended.
Section eight of the principal Act is hereby amended by deleting the words “and without any further or other deduction therefrom”
.
3 Subsection (2) of section 9 of Church Property Trust (Canterbury) Act 1879 amended.
Subsection two of section nine of the principal Act is hereby amended by deleting the words “in respect of the said income payable to the Bishop of Christchurch, or”
.
4 Section 19 of Church Property Trust (Canterbury) Act 1879 amended.
Section nineteen of the principal Act is hereby amended by deleting the words “and without any further or other deduction therefrom”
.
5 Subsection (2) of section 20 of Church Property Trust (Canterbury) Act 1879 amended.
Subsection two of section twenty of the principal Act is hereby amended by deleting the words “in respect of the said incomes, payable to the Dean and Canons respectively, or”
.
6 Date of coming into operation of Act.
This Act shall be deemed to have come into force on the first day of November, nineteen hundred and fifty-one.
7 Costs and charges of Act, how to be paid.
All costs, charges, disbursements, and expenses of and incidental to the preparing for, obtaining, and passing of this Act or otherwise in relation thereto shall be paid by the Church Property Trustees out of the income of the Bishopric Estate and the income of the Dean and Chapter Estate in equal shares.
8 Private Act.
This Act is hereby declared to be a private Act.
