An Act to amend the Canterbury and Otago Boundary Act 1861.
Preamble.
Whereas by an Act of the present Session of the General Assembly of New Zealand intituled “The Canterbury and Otago Boundary Act 1861”
the rights of certain persons who have purchased land or have obtained or applied for depasturing licenses from the Waste Lands Board of either of the said Provinces have been defined and it is expedient that all claims in respect thereof should be fully determined
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows
I Short Title.
The Short Title of this Act shall be “The Canterbury And Otago Boundary Act No. 2 1861.”
II Who to be deemed in actual occupation and possession.
In the Interpretation of “The Canterbury and Otago Boundary Act 1861”
any person or persons who having first obtained a License from the Waste Lands Board of either Province for any run shall have fully complied with the Land Regulations of the same Province in respect of such license shall be taken and deemed to be the person or persons “in actual occupation or possession”
of such run.
III Provinces not to be liable to refund.
Nothing in the recited Act contained nor any decision by any Waste Lands Board under the provisions of the said Act shall be deemed to render either Province liable to pay or refund either to the other Province or to any person any purchase monies rents license fees or any other monies whatsoever received by such Province prior to the passing of the said Act Provided that if any person shall have paid rent to the Province of Otago for a run for which another person shall have paid rent to the Province of Canterbury each of which persons shall have complied with the Regulations of the Province under which he holds his license respectively the person whose license shall by this or the said recited Act become void shall be entitled to a refund of the rent paid for the said run if during the subsistence of his license he shall not have beneficially occupied such run.
IV Act to be read as part of “Canterbury and Otago Boundary Act.”
This Act shall be taken and deemed to be a part of the “Canterbury and Otago Boundary Act 1861”
and to have come into operation simultaneously therewith.”
