An Act to authorise the issue of Crown Grants in certain cases.
Preamble.
Whereas it is right and just that power should be given to the Governor to fulfil all engagements heretofore made on behalf of Her Majesty in respect of the Waste Lands of the Crown or of Lands heretofore ceded by the Natives to the Crown.
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows.—
I Short Title.
The Short Title of this Act shall be “The Crown Grants Act (No. 2) 1862.”
II Governor may fulfil promises &c. in writing.
It shall be lawful for the Governor at any time to fulfil any contract promise or engagement heretofore made by or on behalf of Her Majesty whereof there is evidence in writing with respect to any Land within the Colony whether the same shall have been surveyed or defined by metes and bounds or not.
III Governor may on certain conditions fulfil unwritten promises &c.
It shall be lawful for the Governor at any time to fulfil any contract promise or engagement heretofore made with or to any of the Native Inhabitants of New Zealand by or on behalf of Her Majesty whether there is evidence in writing or not of such contract promise or engagement with respect to any lands ceded by such Natives to Her Majesty on the faith of such contract or promise or engagement on the Governor in Council being satisfied with the evidence produced on behalf of such contract promise or engagement.
