The short Title of this Act shall be the “Birds Protection Act 1862.”

Sections 3 and 4 of the “Protection of Certain Animals Act 1861” are hereby repealed.

No Pheasant or Quail shall be hunted taken or killed except during the months of April May June and July in any year.

No Wild Duck or Wild Goose of any imported species whatever shall be hunted taken or killed at any time whatever before the first day of March which shall be in the year one thousand eight hundred and seventy.

And whereas by Section VIII of the “Protection of certain Animals Act 1861” persons might in certain cases be authorised by the Governor to catch or take certain Animals and Birds or the Eggs of such Birds for the purpose of turning out the same in some other part of the Colony It is hereby provided that no person or persons shall be deemed to be so authorised to catch or take or shall catch or take any Animals or Birds or the Eggs of such Birds unless he or they can show a License so to do under the hand of the Governor of the Colony for the time being And no such License shall in any case have any force or effect for a longer period than twelve calendar months from the date of such License.

If any person shall hunt shoot take or kill any Pheasant or other animal or bird specified by the Governor as coming under the provisions of this section on any Sunday he shall on conviction before a Resident Magistrate or two or more Justices of the Peace be punished by a fine not exceeding five pounds or less than ten shillings in respect of any Male Animal or Bird and not exceeding ten pounds or less than one pound in respect of any Female Animal or Bird such fine to be recovered in a summary way.

This Act shall be deemed and taken to be a part of and shall be construed with the “Protection of Certain Animals Act 1861.”
