An Act to amend the Regulations in force in the Province of Marlborough for the sale and disposal of the Waste Lands of the Crown within the said Province.
Preamble.
[Reserved for the signification of Her Majesty’s pleasure thereon, December 14th, 1863.]
WHEREAS by a Proclamation dated May 19 1856 issued under the hand of His Excellency Governor Gore Browne in Pursuance of an Act of the General Assembly of New Zealand intituled “The Waste Lands Act 1854”
certain Regulations for the sale letting disposal and occupation of the Waste Lands of the Crown within the Province of Nelson which then comprised the present Province of Marlborough were issued and declared to come into force on the first day of July 1856.
And Whereas the said Regulations are now in force within the said Province of Marlborough And Whereas it is expedient to repeal certain clauses of the said Regulations.
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows:—
I Short Title
The Short Title of this Act shall be the “Marlborough Waste Lands Regulations Amendment Act 1863.”
II Regulations of Marlborough validated.
The Regulations for the sale letting disposal and occupation of the Waste Lands of the Crown within the Province of Marlborough actually in operation at the time of the passing of this Act shall subject to the alterations hereby made be deemed to have been duly made and to be and to have been valid in law.
III Certain Clauses repealed.
Clauses 28 34 35 and 36 of the said Regulations are hereby repealed
IV Saving of existing claims.
This Act shall not affect any proceedings already undertaken or claims made under or in virtue of the abovementioned clauses but the same may be completed and determined notwithstanding the repeal thereof.
V Act to be reserved.
This Act shall not come into operation until three months after Her Majesty’s pleasure shall be taken thereon and the same shall have been confirmed by Her Majesty with the advice of Her Privy Council and a Proclamation of such confirmation having been given shall have been made by the Governor and republished in the Government Gazette of the said Province.
VI Copy to be published in the United Service Gazette in London.
The Colonial Secretary shall cause a copy of this Act if the same shall receive Her Majesty’s Assent to be published in the United Service Gazette newspaper in the City of London.
