An Act to Amend “The Native Lands Act 1862”
Preamble.
WHEREAS by “The Native Lands Act 1862”
it is enacted that it shall be lawful for the Governor from time to time by Commission or Order in Council to constitute a Court or Courts for the purpose of ascertaining and declaring who according to Native Custom are the proprietors of any Native lands and the estate or interest held by them therein and for the purpose of granting to such proprietors certificates of their title to such land And it is further enacted that every such Court shall be under the presidency of a European Magistrate and the Court shall have and exercise such powers as the Governor may from time to time appoint And it is expedient to amend the said Act by enabling the Governor from time to time to add to the number of persons constituting any such Court so constituted as aforesaid:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows:—
I Short Title.
The Short Title of this Act shall be “The Native Lands Act Amendment Act 1864.”
II Governor may increase the number of members forming a Court.
It shall be lawful for the Governor from time to time by Commission or Order in Council to add an additional or other member or members to the members already constituting any Court or Courts established or to be established under the said Act as to him shall seem fit without reconstituting such Court or Courts as aforesaid ab initio and any Court whose members shall be so increased or shall have been so increased before the passing of this Act shall be deemed to be and to have been constituted as if the foregoing provision had formed part of the recited Act.
