An Act to remove doubts as to the powers of Provincial Legislatures to create Municipal and other Corporations.
Preamble.
Whereas doubts have arisen whether Superintendents and Provincial Councils in New Zealand have power to create Municipal and other Corporations and it is expedient that such doubts should be set at rest
Be it enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows—
I Short Title.
The Short Title of this Act shall be “The Provincial Corporations Act 1865.”
II Powers of Superintendents and Provincial Councils to create Corporations.
It shall be lawful for the Superintendent and Provincial Council of any Province in New Zealand to make or ordain any Act or Ordinance for creating Municipal and other Corporations within the limits of such Provinces for the purposes and objects in respect whereof Superintendents and Provincial Councils are now empowered to make laws.
III Provisions of previous Acts or Ordinances and all acts done thereunder validated.
All provisions of any Acts or Ordinances passed by any Superintendent and Provincial Council which would have been legal and valid if this Act had been in force at the time of the passing of such Acts or Ordinances shall be and be deemed to have been valid as from the time of passing thereof and all acts done under the authority of any such provisions shall be effectual accordingly.
