An Act to provide for the Registration of Contracts of Bailment of Sheep and Cattle in certain cases.
Preamble.
Whereas it is expedient to provide for the Registration of Contracts of Bailment of Sheep and Cattle in certain cases
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows—
I Short Title.
The Short Title of this Act shall be “The Bailors of Sheep and Cattle Protection Act 1865.”
II Contracts of bailment may be registered.
A true copy of every contract of bailment of sheep or cattle may be filed with the Registrar or Deputy Registrar of the Supreme Court for the Province within which the sheep or cattle comprised in such contract of bailment shall be situate at the time of the making of such contract or in cases within the Province of Marlborough until a Registrar or Deputy Registrar of the Supreme Court shall be appointed therein with the Registrar of the Province of Nelson.
III Registrar to keep lists of contract of bailment filed.
The said Registrar or Deputy Registrar shall cause every such copy filed in his said office under the provisions of this Act to be numbered and shall keep a book or books in his said office in which he shall cause to be entered an alphabetical list of every such contract of bailment containing therein the names addresses and descriptions of the several persons making the same according to the form contained in the Schedule to this Act which said book or books and every copy of contract of bailment filed in the said office may be searched and viewed by all persons at all reasonable times paying to the officer for every search against one person the sum of two shillings and no more.
IV Fee to be paid to Registrar.
There shall be paid to the Registrar or Deputy Registrar upon the filing of every such copy as aforesaid the fee or sum of two shillings and no more.
V Any person to have office copy.
Any person shall be entitled to have an office copy or an extract of every copy of contract of bailment filed as aforesaid upon paying for the same at the rate of fourpence for every folio of seventy- two words contained in such copy or extract.
VI Contracts of bailment filed to specify brands of sheep or cattle.
Every contract of bailment of sheep or cattle so filed as aforesaid shall specify some particular brand or mark to be placed upon the sheep or cattle comprised therein and upon the bailors share of the increase thereof during the continuance of such contract of bailment.
