An Act to grant a Pension to the Widow and Children of the late James Armitage of Waikato Esquire.
Preamble.
Whereas during the year one thousand eight hundred and sixty-three the late James Armitage a Resident Magistrate stationed in the district of Lower Waikato was placed in command of an armed party of Friendly Natives engaged in transporting supplies on the Waikato River for the use of Her Majesty’s Forces engaged in suppressing the present rebellion And whereas the said James Armitage was killed in an attack made by the Rebels upon a party of the Friendly Natives at or near the township of Camerontown on the seventh day of September one thousand eight hundred and sixty- three And whereas it is just that the Widow and Children of the said James Armitage should receive a pension
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows—
I Short Title.
The Short Title of this Act shall be “The Armitage Pension Act 1865.”
II Annuity payable.
There shall be paid to the executors of the said James Armitage out of the General Revenue of the Colony of New Zealand the annual sum of one hundred and fifty pounds for the maintenance and education of the children and to assist in the maintenance of the widow of the said James Armitage to be annually applied by the executors in such manner and in such proportions amongst the said children and widow as they shall think fit.
III When to commence.
The said annual allowance shall be deemed to have commenced on the seventh day of September one thousand eight hundred and sixty-three and to be payable quarterly.
IV When to terminate.
Provided always that if the said executors shall inform the Governor at any time hereafter that the estate of the said James Armitage is sufficient to maintain and educate the said children the said annual allowance shall cease and shall in any case terminate on the seventh day of September one thousand eight hundred and seventy- seven Provided also that if the widow of the said James Armitage shall marry or die whilst the said annual sum is payable the same shall be diminished by fifty pounds and if any of the children shall die during such period the same shall be diminished by the sum of fourteen pounds for each child so dying.
