An Act to provide for the collection by means of Stamps of Fees payable in the Supreme Court and in the offices belonging thereto and in certain other offices.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows—
I Short Title.
The Short Title of this Act shall be “The Supreme Court and Registration Offices (Fees) Act 1866.”
II From and after a time to be fixed all fees payable in Supreme Court to be collected by Stamps.
From and after such time as the Colonial Treasurer with the concurrence of the Judges of the Supreme Court of New Zealand or any two of them shall by notice published in the New Zealand Gazette appoint the following fees shall be collected by Stamps namely all fees for the time being payable in the Supreme Court and the several offices or to the several officers or in respect of the several matters specified in Schedule A. to this Act whether under the several enactments therein specified or otherwise and all fees whatever for the time being payable under any of those enactments and from and after such time as the Colonial Treasurer with the concurrence of the Registrar-General of Land shall by notice published in the New Zealand Gazette appoint the following fees shall be collected by Stamps namely all fees for the time being payable in the several offices or to the several officers or in respect of the several matters specified in the Schedule B. to this Act whether under the several enactments therein specified or otherwise and all fees whatever for the time being payable under any of those enactments.
III Stamps to be impressed or adhesive
All or any Stamps to be used under this Act shall be impressed or adhesive as the Colonial Treasurer may from time to time direct.
IV General rules to be made by Treasurer.
The Colonial Treasurer with the concurrence of the Judges of the Supreme Court or any two of them may from time to time make such rules as seem fit for regulating the use of Stamps under this Act and particularly for prescribing the application thereof to documents from time to time in use or required to be used for the purposes of such Stamps and for ensuring the proper cancellation of adhesive Stamps and keeping accounts of such Stamps.
V Documents not properly stamped to be invalid.
Any document which ought to bear a Stamp under this Act shall not be of any validity unless and until it is properly stamped but if any such document is through mistake or inadvertence received filed or used without being properly stamped any Judge of Supreme Court may if he thinks fit order that the same be stamped as in such order may be directed and on such document being stamped accordingly the same and every proceeding relative thereto shall be as valid as if such document had been properly stamped in the first instance.
VI Nothing to interfere with powers of Supreme Court &c for alteration of fees &c.
Nothing in this Act shall interfere with the exercise by any of the Judges of the said Supreme Court or by any other authority of any power of altering or otherwise regulating the amount of any fees comprised in this Act.
