An Act to amend “The Volunteer Act 1865.”

Preamble

WHEREAS it is expedient to amend “The Volunteer Act 1865”

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows—

I Short Title.

The Short Title of this Act shall be “The Volunteer Act Amendment Act 1866.”

II Ninth Section of Volunteer Act 1865 repealed.

No person to be a Volunteer who is not a British subject.

The ninth section of “The Volunteer Act, 1865” is hereby repealed.

In lieu thereof it is hereby enacted as follows—

No person shall be an Officer in the Volunteer Force or a Volunteer or a Non-commissioned Officer of the Volunteer permanent staff who is not a British subject Provided always that no person shall be an Officer in the Volunteer Force until he is competent to perform all the duties appertaining to his office.

III Twenty-sixth Section of Volunteer Act 1865 repealed.

Commissioned Officers and efficient Volunteers exempt from serving as jurors except on a Coroner’s or Grand Jury.

The twenty-sixth Section of “The Volunteer Act 1865” is hereby repealed.

In lieu thereof it is hereby enacted as follows—

Every Commissioned Officer of the Volunteer Force and every Volunteer who shall hold a certificate of efficiency granted under and in accordance with the provisions of “The Volunteer Act 1865” or any rules or regulations made thereunder and for the time being in force shall if he shall so claim it be exempt from serving on juries within the Colony of New Zealand Provided always that nothing herein contained shall have the effect of exempting Volunteers from service upon any Coroner’s Jury or Grand Jury.
