An Act to remove doubts as to the qualifications of Gold Fields Members of the House of Representatives and of Provincial Councils.

Preamble

WHEREAS doubts exist whether persons entitled by virtue of “The Miners’ Representation Act 1862” and of “The Miners’ Representation Act 1863” and of “The Miners’ Representation Act Amendment Act 1865” to vote at certain elections of Members of the House of Representatives and of Provincial Councils are duly qualified to be elected as Gold Fields Members of the House of Representatives or of Provincial Councils and whereas it is desirable that such doubts should be removed

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows—

I Short Title.

The Short Title of this Act shall be “The Gold Fields Members Qualification Act 1866.”

II Elections for Westland not to be deemed invalid in certain cases.

No election which has already taken place or which may take place before the end of the next session of the General Assembly of any Gold Fields Member of the House of Representatives or of any Member of the House of Representatives for the District of Westland or of any Member of a Provincial Council for any Provincial Electoral District comprised within the said District of Westland shall be deemed to have been or to be invalid by reason of the person so elected not having possessed or not possessing any other qualification than those provided in the above-recited Acts or any of them.

III Previous elections declared valid.

All elections of Gold Fields Members of the House of Representatives or of any Provincial Council which have taken place since the above-recited Acts have come into operation shall be and be deemed to have been valid as from the time of the holding thereof as also any elections of Gold Fields Members that may take place under the said recited Acts between the time of the passing of this Act and the next session of the General Assembly.
