The Short Title of this Act shall be “The Volunteer Act Amendment Act 1867.”

The twenty-first section of “The Volunteer Act 1865” is hereby repealed.

All money subscribed by or for the use of any corps except where duly vested in trustees and all arms stores ammunition or musical instruments or other articles whatever belonging to or used by any such corps not being the property of any one member of the corps shall be vested in the Commanding Officer of such corps for all purposes of any proceeding criminal or civil at law or in equity and shall for such purposes be deemed to be his property and may be so laid in any information action or suit and no such information action or suit shall be discontinued by the death resignation or removal of a Commanding Officer but the same may be proceeded in by the succeeding Commanding Officer.

Any money or other real or personal property whatsoever which at the time of the disbandment of any corps already disbanded or hereafter to be disbanded under the provisions of “The Volunteer Act 1865” was subject to any trust for the benefit of the corps shall be disposed of by the person or persons in whom the same is vested in such manner and for such uses public or private as shall be resolved upon by a majority of such of the persons who were members of the disbanded corps at the time of the disbandment thereof as may be present at a meeting summoned for the purpose by the last Commanding Officer of the corps or in the event of his death or absence from the Colony by the Adjutant of the district to which the corps belonged by advertisement in some newspaper published or circulating in the said district such advertisement giving not less than fourteen days notice of the meeting and stating the purpose thereof.

Nothing in the twenty-fifth section of “The Volunteer Act 1865” shall be deemed to take away any exemption from training and exercise in the New Zealand Militia to which any Volunteer may have been entitled on the twenty-eighth day of February one thousand eight hundred and sixty-six.
