An Act to amend certain provisions of “The Census Act 1858”
and “The Census Act Amendment Act 1860.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows—
1 Short Title.
The Short Title of this Act shall be “The Census Acts Amendment Act 1867”
and it shall be read as and deemed and taken to be part of “The Census Act 1858”
as amended by “The Census Act Amendment Act 1860.”
2 Repeal clause.
The third and fourth parts of the Schedule A. annexed to “The Census Act 1858”
hereinafter referred to as “the said Act”
are hereby repealed.
3 Additional particulars required.
In the stead and place of the matters mentioned in such third and fourth parts of the said Schedule information shall be obtained by the enumerators and sub-enumerators at every general census with respect to the subjects comprised in the Schedule to this Act annexed.
4 Annual account of land in cultivation and agricultural produce.
In addition to the general census provided for in “The Census Act 1858”
an account shall be taken in the month of February in the year one thousand eight hundred and sixty-nine and in the same month or such other month as the Governor shall from time to time appoint in every succeeding year of the land in cultivation within New Zealand and of the agricultural produce thereof.
5 Governor to make regulations for taking account.
It shall be lawful for the Governor from time to time to make such regulations and to appoint such persons as may be found necessary for the purpose of taking the accounts hereby authorized and of making up the returns to be compiled therefrom.
6 Provincial returns therefrom to be published in Provincial Gazettes.
From the account to be taken under the third and fourth sections of this Act a return shall be compiled with as little delay as possible of the land in cultivation in each Province and of the agricultural produce thereof and shall be published in the Government Gazette of the Province to which the same shall relate and also in the New Zealand Gazette.
7 Powers provisions &c. under former Acts to apply to this Act.
All the powers provisions pains and penalties by the said Act as amended given to and imposed upon the several enumerators and sub-enumerators appointed under the provisions of the said Act and thereby required to fill up any form and the persons of whom they are thereby authorized to require information shall so far as they shall be applicable apply to and be in force respecting the accounts hereby directed to be taken and to the enumerators and sub-enumerators and person or persons employed to take such accounts respectively and to the person or persons required to fill up any form or forms or to give any information necessary for the purposes of this Act as if the same were here expressly re-enacted in relation thereto.
8 Penalty on divulging information obtained under Census Acts.
The information obtained pursuant to the said Act or to this Act shall be used only for the purpose of compiling the accounts by the said Act and by this Act authorized to be taken and any person who shall divulge or for any other purpose make use of the information so obtained shall for every such offence forfeit the sum of twenty pounds recoverable by way of summary proceeding in the manner directed by “The Justices of the Peace Act 1866”
or by any Act in force for regulating summary proceedings before Justices of the Peace.
