An Act to relieve the Provinces from the obligation to refund Sums paid to them in excess of Surplus Revenue.
Preamble.
Whereas certain sums have been paid to the several Provinces of New Zealand by way of Surplus Revenue in excess of the sums distributable under “The Surplus Revenues Act 1858”
And it is expedient that the Provinces should be released from the obligation to refund the same to the General Revenue except in so far as may be necessary in order to effect an equitable Interprovincial adjustment of the total sum so paid in excess
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows—
1 Short Title.
The Short Title of this Act shall be “The Surplus Revenue Adjustment Act 1867.”
2 Certain Provinces to pay certain sums to General Government.
The following several Provinces shall pay to the General Government the following several sums that is to say—
The Province of Hawke’s Bay shall pay Three hundred and one pounds and four shillings
The Province of Otago shall pay Twenty-five thousand one hundred and forty pounds eight shillings and ten pence and
The Province of Southland shall pay Five thousand six hundred and eleven pounds seventeen shillings and nine pence.
3 General Government to pay certain sums to certain Provinces.
The General Government shall pay the following several sums to the following several Provinces that is to say—
To the Province of Auckland Twenty-five thousand and three pounds thirteen shillings and four pence
To the Province of Wellington Four thousand eight hundred and sixteen pounds and one penny
To the Province of Nelson Six hundred and fifteen pounds four shillings and five pence and
To the Province of Canterbury six hundred and eighteen pounds twelve shillings and five pence.
4 Above payments to close Accounts under Surplus Revenues Act.
Except as provided by this Act no further sums shall be paid by or to or shall be charged against or to the credit of any Province in account with the General Government under the provisions of “The Surplus Revenues Act 1858”
for the period prior to the thirtieth day of June one thousand eight hundred and sixty-seven.
5 Payments when and how to be made.
The sums so payable to the General Government by each of such Provinces shall be payable in four equal quarterly instalments whereof the first shall be payable on the thirtieth day of September in the present year and the Colonial Treasurer may deduct all such sums payable by any Province as they shall become due from any moneys payable to such Province and shall forthwith pay over all sums so received to the Provincial accounts of the Provinces hereby entitled to receive the same in proportion to the amounts of their several claims under this Act.
