Contents
An Act to validate certain Ordinances of the Provincial Councils of Canterbury and Marlborough and to validate and empower the Governor to assent to a certain Bill passed by the Provincial Council of Hawke’s Bay.
Preamble.
WHEREAS the Schedule to “The Appropriation Ordinance 1868”
of the Provincial Council of Canterbury contains among other items a sum of two thousand three hundred and four pounds (£2,304) payable for interest on an overdraft with the Bank of New Zealand incurred by the Superintendent of the said Province And whereas the Schedule to “The Appropriation Ordinance No. 2 1868”
of the Provincial Council of Canterbury contains among other items a sum of fifty-one thousand six hundred and ninety-nine pounds seventeen shillings and one penny (£51,699 17s. 1d.) payable to the Bank of New Zealand in extinction of an overdraft to that amount incurred by the Superintendent of the said Province And whereas the Schedule to “The Appropriation Act 1868–9”
of the Provincial Council of Canterbury contains among other items a sum of five hundred pounds (£500) payable for interest on an overdraft with the Bank of New Zealand incurred by the Superintendent of the Province last mentioned And whereas the Provincial Council of Hawke’s Bay did in the last Session of the said Council pass the Bill mentioned in the second Schedule hereto purporting to provide that the Superintendent of the Province of Hawke’s Bay should be thereby authorized out of the Revenue accruing to the said Province for the year ending the thirtieth day of June one thousand eight hundred and sixty-nine to repay an advance of two thousand four hundred and four pounds (£2,404) sterling made by the Bank of New Zealand to the Superintendent of the said last-mentioned Province And whereas the said several Ordinances and the said Bill were respectively passed after the passing of “The Consolidated Loan Act 1867”
whereby it is amongst other things provided that after the passing of the said Act no Act or Ordinance which may be passed by any Provincial Council of any Province for raising any Loan shall be valid And whereas such overdrafts are deemed to be illegal And whereas it is desirable to remove all doubts as to the validity of the above-named Acts or Ordinances and the said Bill and to authorize the Governor to assent to the said Bill
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows (that is to say)—
1 Short Title.
The Short Title of this Act shall be “The Provincial Appropriations Validation Act 1868.”
2 Ordinances and Act in first Schedule validated.
The several Ordinances and the Act mentioned in the first Schedule hereto shall be deemed to have been valid from the dates respectively set opposite to the same in the said Schedule anything in “The Consolidated Loan Act 1867”
to the contrary notwithstanding.
3 Governor authorized to assent to Bill in second Schedule.
The Governor is hereby authorized to assent to the Bill mentioned in the second Schedule hereto and the said Bill shall be deemed to have the force of law from such date as Bills passed by the Provincial Council of Hawke’s Bay reserved for the Governor’s assent and assented to by him do by law come into operation anything in “The Consolidated Loan Act 1867”
to the contrary notwithstanding.
