An Act to apply several Sums of Money out of the Fifth Division of the Special Fund to the Payment of certain Liabilities attaching to Confiscated Lands and to the Departmental Administration thereof for the Year ending Thirtieth June One thousand eight hundred and sixty-eight.
Preamble.
WHEREAS a sum of fifteen thousand six hundred and fifty-seven pounds thirteen shillings and ninepence (£15,657 13s. 9d.) has been paid during the year ending thirtieth June one thousand eight hundred and sixty-eight in excess of appropriation to meet certain liabilities and defray certain expenses attaching to lands taken under “The New Zealand Settlements Act 1863”
and “The New Zealand Settlements Amendment and Continuance Act 1865”
And whereas it is expedient to indemnify the Colonial Treasurer for such payment and to provide without delay for further liabilities and expenses of the like nature
Be it enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows—
1 Short Title.
The Short Title of this Act shall be “The Confiscated Land Revenue Appropriation Act 1868.”
2 Indemnity to Treasurer.
There shall be charged upon the fifth division of the Special Fund the sum of fifteen thousand six hundred and fifty-seven pounds thirteen shillings and ninepence (£15,657 13s. 9d.) expended during the year ending the thirtieth June one thousand eight hundred and sixty-eight in excess of appropriation for departmental expenditure and outstanding liabilities attaching to the said lands and the Colonial Treasurer is hereby indemnified for such unauthorized payment and against any suit commenced or to be commenced under section sixty-four of “The Public Revenues Act 1867”
in respect of the amount so paid or any part thereof and every such suit shall from and after the date hereof be discharged and made void.
3 Appropriation for outstanding liabilities.
There shall be paid out of the said fifth division of the Special Fund the further sum of twenty-eight thousand pounds (£28,000) to discharge liabilities outstanding against the said lands in respect of compensation to Natives for lands taken payment for the Kati Kati and Puna Block surveys of Native awards and miscellaneous claims.
4 Appropriation for departmental expenditure for current year.
There shall be paid out of the said fifth division of the Special Fund for the departmental services of the year ending the thirtieth June one thousand eight hundred and sixty-nine connected with the administration of the said lands in Auckland the sum of one thousand five hundred pounds (£1,500) in Hawke’s Bay the sum of five hundred pounds (£500) in Taranaki and Wellington one thousand pounds (£1,000) general contingencies five hundred pounds (£500).
5 Treasury Bills charged on receipts on Special Fund.
After payment of the current departmental expenses all sums accruing to the said fifth division of the Special Fund shall be applied from time to time to take up and withdraw from circulation the Treasury Bills issued under authority of section four of “The Treasury Bills Act 1868.”
6 Interpretation.
The expression “the fifth division of the Special Fund”
where used in this Act shall mean so much of the Revenue at the credit of the Special Fund as accrues from such moneys as are mentioned in the fifth sub-section of the fifth section of “The Public Revenues Act 1867.”
