The Short Title of this Act shall be “The Appropriation Act 1868.”

In addition to the sum of One hundred thousand pounds (£100,000) already authorized to be applied to the service of the year ending on the thirtieth day of June one thousand eight hundred and sixty-nine by “The Imprest Supply Act 1868” and to the sum of Thirty thousand pounds (£30,000) authorized to be applied to the service of the said year by “The Imprest Supply Act (No. 2) 1868” there shall and may be issued and applied out of the Consolidated Fund of New Zealand and out of the moneys authorized to be raised by “The Treasury Bills Act 1868” and out of the moneys arising out of the balance hereinafter mentioned in the fourth section hereof of the sum of One million and eighty thousand five hundred and eighty pounds (£1,080,580) part of the moneys raised under “The Consolidated Loan Act 1867” and out of the sum of Fifty-five thousand one hundred and seventy-seven pounds six shillings and fourpence (£55,177 6s. 4d.) part of the moneys raised under “The Consolidated Loan Act 1867” and being the sum applied or applicable under the said Act and “The Public Debts Act 1867” to the payment or discharge of the liability of the Province of Southland to the General Government and applied or applicable under the said Acts to the discharge of payments to be made to the General Government under “The Southland Provincial Debt Act 1865” and “The Southland Provincial Debt Act Amendment Act 1866” towards making good the Supply granted to Her Majesty for the service of the said year a further sum of Four hundred and ninety thousand five hundred and sixty pounds sixteen shillings and tenpence (£490,560 16s. 10d.)

Out of all or any of the supplies or aids aforesaid there shall and may be issued and applied in addition to all other sums of money now by law permanently appropriated any sum or sums of money not exceeding in the whole the amount of Six hundred and twenty thousand five hundred and sixty pounds sixteen shillings and tenpence (£620,560 16s. 10d.) towards or for the purposes hereinafter expressed which will come in course of payment during the year ending the thirtieth day of June one thousand eight hundred and sixty-nine that is to say—

Any sum or sums of money not exceeding Two thousand eight hundred and eighty pounds (£2,880) to defray the salaries contingencies and expenses of Public Domains and Buildings.

And any sum or sums of money not exceeding Thirty-eight thousand five hundred and forty-three pounds seven shillings and threepence (£38,543 7s. 3d.) to defray the salaries contingencies and expenses of Public Departments in the manner hereinafter expressed that is to say—for Governor’s Establishment One thousand six hundred pounds (£1,600) for Legislative Departments Twelve thousand two hundred and twenty-one pounds ten shillings and threepence (£12,221 10s. 3d.) for Executive Departments Eight thousand and fifty-one pounds five shillings (£8,051 5s.) for Stamp Office Five hundred and eighty-four pounds twelve shillings (£584 12s.) for Printing Department Five thousand seven hundred and eighty-six pounds (£5,786) for Geological Survey Two thousand four hundred and fifty pounds (£2,450) and for Provincial Charges Paymasters’ Departments Two thousand four hundred and fifty-five pounds (£2,455) for Stamp Office One thousand eight hundred and seventy pounds (£1,870) and for Electoral Departments Three thousand five hundred and twenty-five pounds (£3,525).

And any sum or sums of money not exceeding Fifty-seven thousand nine hundred and twelve pounds ten shillings and elevenpence (£57,912 10s. 11d.) to defray the salaries contingencies and expenses of Departments of Law and Justice in the manner hereinafter expressed that is to say—for General Charges Three thousand four hundred and forty-seven pounds ten shillings (£3,447 10s.) for Provincial Charges Fifty-four thousand four hundred and sixty-five pounds and elevenpence (£54,465 0s. 11d.)

And any sum or sums of money not exceeding One hundred and sixteen thousand two hundred and thirty-six pounds eighteen shillings and sevenpence (£116,236 18s. 7d.) to defray the salaries contingencies and expenses of Postal Departments in the manner hereinafter expressed that is to say—for General Charges General Post Office Three thousand and sixty-five pounds (£3,065) Conveyance of Mails by Sea Twenty thousand nine hundred and thirty-one pounds three shillings and sevenpence (£20,931 3s. 7d.) and Provincial Charges Province of Auckland Six thousand four hundred and two pounds (£6,402) Province of Taranaki Six hundred and twenty pounds (£620) Province of Hawke’s Bay One thousand eight hundred and sixty-nine pounds (£1,869) Province of Wellington Four thousand four hundred and seventy-six pounds (£4,476) Province of Nelson Four thousand two hundred and sixty pounds (£4,260) Province of Marlborough One thousand five hundred and twenty-eight pounds (£1,528) Province of Canterbury Ten thousand seven hundred and eighty-seven pounds (£10,787) County of Westland Six thousand one hundred and seventyeight pounds (£6,178) Province of Otago Twenty-one thousand and forty pounds (£21,040) Province of Southland Two thousand three hundred and five pounds (£2,305) and for General Charges Telegraph Department Two thousand five hundred pounds (£2,500) for Provincial Charges Twenty-two thousand two hundred and ninety-five pounds fifteen shillings (£22,295 15s.) And any sum or sums of money not exceeding Forty-two thousand two hundred and eighty-eight pounds twelve shillings and sixpence (£42,288 12s. 6d.) to defray the salaries contingencies and expenses of the Customs Departments in the manner hereinafter expressed that is to say—for General Charges Three thousand two hundred and fifteen pounds (£3,215) for Provincial Charges Province of Auckland Eight thousand one hundred and sixty-two pounds ten shillings (£8,162 10s.) Province of Taranaki Four hundred and ninety pounds (£490) Province of Hawke’s Bay One thousand two hundred and twenty-five pounds (£1,225) Province of Wellington Four thousand three hundred and seventy-eight pounds two shillings and sixpence (£4,378 2s. 6d.) Province of Nelson Three thousand six hundred and ninety-nine pounds (£3,699) Province of Marlborough Six hundred and forty pounds (£640) Province of Canterbury Four thousand seven hundred and ninety-eight pounds (£4,798) County of Westland Five thousand and seventy-one pounds (£5,071) Province of Otago Six thousand nine hundred and ten pounds (£6,910) Province of Southland Two thousand two hundred pounds (£2,200)—for Distillation One thousand five hundred pounds (£1,500).

And any sum or sums of money not exceeding Seventeen thousand six hundred and sixty-three pounds twelve shillings and and sixpence (£17,663 12s. 6d.) for salaries contingencies and expenses of the Native Departments in the manner hereinafter expressed that is to say—for General Contingencies One thousand pounds (£1,000) for Salaries of European and Native Officers Eleven thousand five hundred and eighty-three pounds twelve shillings and sixpence (£11,583 12s. 6d.)—for Provincial Charges Native Lands Court Survey Department Five thousand pounds (£5,000) Remission of Duty under Native Lands Act Eighty pounds (£80).

And any sum or sums of money not exceeding One hundred and ninety thousand two hundred and fifteen pounds six shillings and sixpence (£190,215 6s. 6d.) to defray the charges contingencies and expenses of various Miscellaneous Special and Temporary Objects in the manner hereinafter expressed that is to say—for General Charges Miscellaneous Special and Temporary Objects Thirty thousand seven hundred and fifteen pounds six shillings and sixpence (£30,715 6s. 6d.) Payment of Treasury Bills One hundred and fifty thousand pounds (£150,000) Bank Commission Three thousand five hundred pounds (£3,500) and for Provincial Charges Advances to Native Lands Courts Six thousand pounds (£6,000).

And any sum or sums of money not exceeding One hundred and fifty-four thousand eight hundred and twenty pounds eight shillings and sevenpence (£154,820 8s. 7d.) to defray the salaries contingencies and expenses of Militia and Volunteers in the manner hereinafter expressed that is to say—for General Charges Militia and Volunteer Establishment Three thousand two hundred and sixty-six pounds ten shillings (£3,266 10s.) for Volunteer and Militia Miscellaneous Six thousand five hundred and eighty-six pounds (£6,586) for Armed. Constabulary Eighty thousand nine hundred and thirty-eight pounds three shillings and sixpence (£80,938 3s. 6d.) for Contingent Defence Fifty thousand pounds (£50,000) for Provincial Charges Militia and Volunteer Services Fourteen thousand and twenty-nine pounds fifteen shillings and one penny (£14,029 15s. 1d.)

Out of the sum of One million and eighty thousand five hundred and eighty pounds (£1,080,580) part of the moneys raised under “The Consolidated Loan Act 1867” for the purposes specified in Schedule B. to “The Public Debts Act 1867” and which have not been and shall not be required for and issued and applied to the purposes to which the same may under the provisions of the said Acts be applied there may be issued and applied to defray the charges and expenses of the services mentioned in the Schedule hereto which have already or shall hereafter come in course of payment and in addition to the sums which are authorized by the said Acts to be applied to like services to those mentioned in the Schedule hereto any sum or sums of money not exceeding the sum of Three thousand four hundred and twelve pounds (£3,412) and the balance of the said sum of One million and eighty thousand five hundred and eighty pounds (£1,080,580) so raised and not required issued or applied for the purposes and services aforesaid shall and may be issued and applied in defraying the charges and expenses which may come in course of payment before the first day of July one thousand eight hundred and sixty-nine for Colonial Defence and is to be taken as included in the sums of Eighty thousand nine hundred and thirty-eight pounds three shillings and sixpence (£80,938 3s. 6d.) and Fifty thousand pounds (£50,000) already appropriated in section three of this Act.

Out of the sum of Fifty-five thousand one hundred and seventy-seven pounds six shillings and fourpence (£55,177 6s. 4d.) part of the moneys raised under “The Consolidated Loan Act 1867” and being the sum applied or applicable under the said Act and “The Public Debts Act 1867” to the payment or discharge of the liability of the Province of Southland to the General Government and applied or applicable under the said Acts to the discharge of payments to be made to the General Government under “The Southland Provincial Debt Act 1865” and “The Southland Provincial Debt Act Amendment Act 1866” there may be issued and applied in addition to all other sums by law appropriated to the same or similar services any sum or sums up to the said sum of Fifty-five thousand one hundred and seventy-seven pounds six shillings and fourpence (£55,177 6s. 4d.) to defray the charges and expenses of the services following that is to say— Telegraph General Charges Telegraph Extension Twenty-four thousand pounds (£24,000) Government House and Government Offices Fifteen thousand pounds (£15,000) Marine Survey Three thousand pounds (£3,000) and Thirteen thousand one hundred and seventy-seven pounds six shillings and fourpence (£13,177 6s. 4d.) being the balance of the said sum of Fifty-five thousand one hundred and seventy-seven pounds six shillings and fourpence (£55,177 6s. 4d.) for Contingent Defence which said sum of Thirteen thousand one hundred and seventy-seven pounds six shillings and fourpence (£13,177 6s. 4d.) is to be taken as included in the sum of Eighty thousand nine hundred and thirty-eight pounds three shillings and sixpence (£80,938 3s. 6d.) and Fifty thousand pounds (£50,000) already appropriated in section three of this Act.

The sums authorized to be issued and applied by the next preceding section of this Act shall not be subject to the provisions of the forty-second section of “The Public Revenues Act 1867” but shall be deemed to be permanently appropriated to and for the services to and for which such sums are by the provisions of the said section authorized to be issued and applied.

Whereas in accordance with the provisions of the fifteenth section of “The Comptroller’s Act 1865” the unexpended balances of the Appropriations for the year ending the thirtieth day of June one thousand eight hundred and sixty-seven were in the Treasury Accounts carried to the credit of the following year And whereas certain sums on the said thirtieth of June held in reserve and certain other sums received as revenue of the year ending on the said thirtieth day of June have been credited by the Colonial Treasurer in such accounts as revenue of that year the said several sums being particularized hereunder and amounting in the whole to One hundred and twenty-seven thousand and ninety-eight pounds eight shillings and sevenpence (£127,098 8s. 7d.) that is to say—

And whereas out of the sums of money hereinbefore specified certain expenditure was made prior to the first day of July One thousand eight hundred and sixty-seven amounting in the whole to One hundred and twenty thousand three hundred and thirty-six pounds ten shillings (£120,336 10s.) which said sum has been charged in the Treasury Accounts on the aforesaid sum of one hundred and twenty-seven thousand and ninety-eight pounds eight shillings and sevenpence (£127,098 8s. 7d.) And whereas of the said expenditure sums amounting to One hundred and eighteen thousand seven hundred and forty-five pounds three shillings (£118,745 3s.) were authorized by law and One thousand five hundred and ninety-one pounds seven shillings (£1,591 7s.) was expenditure made without authority of law And whereas such unauthorized expenditure was necessary for the Public Service And whereas the charging of the said expenditure of One hundred and twenty thousand three hundred and thirty-six pounds ten shillings (£120,336 10s.) in such Accounts in the manner aforesaid on the said sum of One hundred and twenty-seven thousand and ninety-eight pounds eight shillings and sevenpence (£127,098 8s. 7d.) was made necessary by the coming into operation of “The Public Revenues Act 1867” Be it therefore enacted that the several Colonial Treasurers and all other persons whatsoever are hereby indemnified for the charging of the said sums as aforesaid and also for the expenditure of the said sum of One thousand five hundred and ninety-one pounds seven shillings (£1,591 7s.) and the Colonial Treasurer shall receive credit in his Accounts for the said last-mentioned sum accordingly.

And whereas the actual expenditure of the General Government for the year ending on the thirtieth day of June One thousand eight hundred and sixty-eight exceeded the sum authorized by law by the sum of Eight thousand one hundred and forty-three pounds six shillings and twopence (£8,143 6s. 2d.) And whereas the said expenditure in excess was reasonable and necessary Be it therefore enacted the several Colonial Treasurers and all persons whatsoever are hereby indemnified for the expenditure of the said sum of Eight thousand one hundred and forty-three pounds six shillings and twopence (£8,143 6s. 2d.) and the Colonial Treasurer shall receive credit in his Accounts for the said sum accordingly.

The Treasurer of New Zealand shall issue and pay the said several sums hereby appropriated to such persons for the purposes hereinbefore mentioned upon such days and in such proportions as the Governor may by any warrant to be signed by him order and direct and the payment so to be made shall be charged upon and payable out of such supplies and aids as aforesaid.

The said Treasurer shall in his accounts from time to time be allowed credit for any sum of money paid by him in pursuance of any warrant issued by virtue of this Act and the receipt of the person to whom the same shall be so paid shall be a full and valid discharge to the said Treasurer in passing his said accounts for any such sum as shall be therein mentioned.
