An Act to continue “The Provincial Acts Validation Act 1867”
and“ The Provincial Acts Validation Act Continuance Act 1868”
and to validate certain Provincial Acts and Ordinances.
Preamble.
WHEREAS by “The Provincial Acts Validation Act 1867”
it was enacted that the said Act should continue in force until the end of the then next Session of the General Assembly and no longer And whereas by “The Provincial Acts Validation Act Continuance Act 1868”
it was enacted that “The Provincial Acts Validation Act 1867”
with the exception therein mentioned should continue in force until the end of the then next Session of the General Assembly And whereas it is expedient that the said first mentioned Act should be continued in operation
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows—
1 Short Title.
The Short Title of this Act shall be “The Provincial Acts Validation Act Continuance Act 1869.”
2 Repeal.
So much of “The Provincial Acts Validation Act Continuance Act 1868”
as limits the duration or continuance of “The Provincial Acts Validation Act 1867”
is hereby repealed.
3 “Provincial Acts Validation Act 1867”
continued.
“The Provincial Acts Validation Act 1867”
as amended by “The Provincial Acts Validation Act Continuance Act 1868”
except so much of the said first-mentioned Act as relates to and purports to validate the Act of the Superintendent and Provincial Council of Marlborough set out in the first part of the fifth Schedule to the said first-mentioned Act and except so far as the said first-mentioned Act or any of the Acts mentioned in the Schedule thereto is or are or may he altered or affected by any of the Acts or Ordinances mentioned in the Schedules to this Act shall continue in force until the end of the next Session of the General Assembly and the Acts or Ordinances the validation whereof is continued hereby shall henceforth and until the end of the next Session of the General Assembly have the same force and effect as if enacted by the General Assembly of New Zealand.
4 Provincial Legislatures empowered to repeal or amend these Acts or Ordinances though validated or incorporated with Acts of Assembly.
If the Provincial Legislature of any Province shall within the powers vesting in them at any time while this Act continues in force pass any Bill for repealing altogether or in part or amending any Act or Ordinance mentioned or set forth in any of the Schedules to “The Provincial Acts Validation Act 1867”
so amended as aforesaid or in any of the Schedules to this Act such Bill if assented to by the Superintendent in cases where he has power to assent to Bills and not disallowed by the Governor or if assented to by the Governor shall so far as it purports to repeal or amend any such Ordinance be valid and of full effect notwithstanding that the Act or Ordinance thereby repealed is incorporated in or re-enacted by an Act of the General Assembly and thereupon the Act or Ordinance so repealed or amended shall be deemed not to be included in the Schedules to this Act or to either of the Acts hereby continued Provided that no such Bill shall have any force or effect beyond the limits of the Province in which such Provincial Council is sitting.
5 Certain Bills of Provincial Council of Canterbury and Marlborough if assented to to be valid.
And whereas it is expedient that certain Bills passed by the Provincial Legislature of the Province of Canterbury and by the Provincial Legislature of Marlborough respectively and reserved for the assent of the Governor should if such assent shall be given have the force of law Be it enacted that if the Governor shall assent to one or more of the Bills mentioned in the Schedule A. to this Act such Bill or every such Bill as the case may he shall from the time of the coming into operation thereof as an Ordinance as hereinafter defined and until the end of the next Session of the General Assembly have the same force and effect as if enacted by the General Assembly and such Bill or every such Bill as the case may he shall come into operation as an Ordinance on the day of such assent being given except in the case of “The Trespass of Cattle Ordinance 1869”
which shall if assented to as aforesaid come into operation on the first day of September one thousand eight hundred and sixty-nine.
6 “The Picton Improvement Act Amendment Act 1867”
validated.
And whereas it is expedient that a certain Act passed by the Provincial Legislature of Marlborough shall be validated Be it enacted that the Act specified in Schedule B. to this Act shall be deemed to have been from the date of the assent of the Governor legal and valid and all things done in pursuance of such Act shall be deemed to have been as legally done and as valid as if done after the passing of this Act.
