An Act to amend “The Walsh and Others Pension Act 1869.”
Preamble.
WHEREAS by the fifth section of “The Walsh and Others Pension Act 1869”
hereinafter referred to as “the said Act”
it is provided that it shall be lawful for the said person or persons so appointed as aforesaid to select within six months from the passing of the said Act free of cost in one allotment or in any number of contiguous allotments one hundred acres from any lands within the Province of Hawke’s Bay taken under “The New Zealand Settlements Act 1863”
and not then sold or agreed to be sold and not then reserved from sale and upon any such selection being made it shall be lawful for the Governor to execute a Crown Grant thereof without payment of any purchase money to such persons as the Governor shall think fit in trust for the said James Wilson under this Act And whereas no such selection as in the said section of the said Act mentioned has yet been made and it is expedient to extend the time for making such selection and also to authorize such selection to be made from any such lands in Poverty Bay as are hereinafter mentioned instead of from the lands mentioned in the said section of the said Act
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows—
1 Short Title.
The Short Title of this Act shall be “The Walsh and Others Pension Act Amendment Act 1870.”
2 Fifth section of said Act repealed. Selection may be made from lands mentioned in the Schedule.
The fifth section of the said. Act is hereby repealed and in lieu thereof it is enacted as follows—It shall be lawful for the said person or persons appointed as in the third section of the said Act is provided to select within six months from the passing of this Act free of cost in one allotment or in any number of contiguous allotments one hundred acres of land from any lands within the boundaries mentioned in the Schedule hereto and not for the time being granted or sold or agreed to be granted or sold or reserved for public purposes or from sale and upon ’any such selection being made the Governor may execute a Crown Grant thereof without payment of any purchase money to such person as the Governor shall think fit in trust for the said James Wilson under the said Act.
3 Sections 6 to 10 inclusive of the said Act to be deemed to apply to land selected under this Act.
In the sections of the said Act numbered from six to ten inclusive the term “the said land”
shall be deemed to apply to the land selected under this Act.
Schedule Ngatiporou Reserve, Poverty Bay, Containing about 3,000 Acres
Commencing at the junction of Whakaaha Stream with the Waipao River at Patutahi; thence West up Whakaaha Stream to a place called Te Rainga-o-te-Manu; thence East in a line bearing 63° 30 until it strikes the Waipao River; thence North up the Waipao River to the starting point at Patutahi.
