An Act to make provision for the Renewal of Depasturing Licenses in the Province of Hawke’s Bay.
Preamble.
WHEREAS certain lands in the Province of Hawke’s Bay are now held under depasturing licenses issued under the New Zealand Regulations of March one thousand eight hundred and fifty- three and the additional Land Regulations for the amendment and extension of the same of the fifteenth February one thousand eight hundred and fifty-five And whereas the said licenses are about to expire and it is expedient that provisions be made for the issue of fresh licenses in lieu thereof
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows—
1 Short Title.
The Short Title of this Act shall be “The Hawke’s Bay Renewal of Licenses Act 1870.”
2 Renewal of license terms on which to be granted.
Every holder of a depasturing license under the regulations aforesaid shall at any time before the expiration of such license be entitled to the renewal of his license to occupy for depasturing purposes the land comprised in his former license or such part thereof as shall then be at the disposal of Government for a period of seven years from the date of its expiration and at a yearly rental of one penny for every acre of land to be comprised in such license but subject in all other respects to the like covenants conditions and obligations relating to licenses for depasturing purposes as are in the regulations aforesaid contained.
3 Run to go to auction if renewal license conditions not accepted.
In the event of any such licensee declining to avail himself of the right of renewal hereinbefore given the license to occupy the land comprised in his license or the part thereof at the disposal of Government shall be offered for competition at public auction and be granted to the person who bids the highest annual rent for the same upon the terms and conditions hereinbefore stated except that the term of such license shall be five years instead of seven years as provided in the former case.
